Bought some boots. Size 11 £25 quid. Sports direct failed to deliver. They are going to refund me but I want a replacement and I know that a replacement is available but now more expensive. Refund or replacement is my choice right? And they are contracted to the lower price right?  What are my rights here anyone ?

    Wrong, you are entitled to a refund or replacement, but the choice is the supplier’s not yours.

    You are entitled to be in the position you would have been before you ordered the boots, so £25 richer with no boots.

    You can ask, but they are not obliged to give you it at the discounted rate, only to either fulfil the sale (with the boots) or to put you back to where you were prior to the sale (refund of the whole amount, including postage). 

    When you say ‘failed to deliver’ - did they send the boots and they got lost or have they simply cancelled the order?

    You are entitled to be in the position you would have been before you ordered the boots, so £25 richer with no boots.
    Under standard contract law you are entitled to be in the position you would have been in had the breach of contract not occurred. 

    This is what damages are for, but it's unlikely the amount is worth chasing and Sports Direct aren't known for being generous with their customer service or goodwill.
