Video of abusive/threatening behavior of attendant who issued pcn

Hi all, here's some back story of the situation.. I've just received a letter before claim from Gladstone solicitors for a pcn that was unknowingly issued back in 2019, reason being it was sent to am old address and subsequently sold the car and moved since then. Gladstone say they done a UK search trace to find a trace address for me. Anyway I've read the guide and will be following up the LBC highlighting All of the failings of the practice directions.
Lucky I kept the video from all those years back! Thought the guy knew he'd messed up and didn't peruse me but clearly not!
Should I present the solicitors with it willingly now? Wait to see if they ask, or wait for when putting forward my defence? They haven't asked... am I correct in thinking the practice directions say they should request information (evidence that I have if any)?
If gladstones are presented with the video they would surely agree that its not going to stand in court because of the rogue nature he has operated including abusive foul language and plain bullying tactics of parking firm NPM national parking management and drop the proceedings? Although I'm happy taking this to court and fully defending this!
I can also prove theyre scamming people by working with the company I went to visit that day by paying them a commission! Asking the company to call NPM for parking outside the building so this lovely guy can come and take pictures with his camera! he even admits this in the video.

Hello and welcome.
The first thing you need to do is write to both NPM and Gladstones.
Instruct them to erase the address that they currently have for you and replace it with your current address which you are now telling them.
Failure to do that could easily see them raising a Claim at you old address, you knowing nothing about it and getting a default Judgment against you. Lots of work needed to unravel that.2 -
What does the video show?
Why was the PCN unjust?
I'm on your side but trying to understand why you say that they 'messed up' and that your video is a silver bullet.Lucky I kept the video from all those years back! Thought the guy knew he'd messed up and didn't pursue me but clearly not!
Should I present the solicitors with it willingly now?ANSWER: Yes.
Gladstone say they done a UK search trace to find a trace address for me. Anyway I've read the guide and will be following up the LBC highlighting All of the failings of the practice directions. As KeithP says, you must respond and insist the old address is immediately ERASED from their database, and that of their client. This is vital.
And supply the video in a format they can watch. USB stick?
But it sounds like you've been reading really old stuff like the LBCCC Guide from many years ago by LazyDaisy which is VERY OUT OF DATE. Forget stuff about the PAP.
Just search the forum for Gladstones LBC robust response and change BEST MATCH to 'NEWEST'. Loads of good examples of 'get lost' style replies to LBCs this year.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thankyou both for a prompt and helpful reply. I’m now following the correct steps thanks to coupon-mads advice regarding the newbies section and searching for Gladstones LBC robust response. I’m now reading the posts with those words and picking bits out to draft my own email.I do have a probably silly question now. But gladstones are asking me to create an account on their website and fill out the PAP. I know coupon-max said NOT to bother with that so my question is do I make an account and send my email through they're system or email the generic email address which is something like enquires@gladstones……
I’ve found the email address for NPM so will construct my email now.
again many thanks for your help0 -
Looks like good advice to me... whoever coupon-max is.Tommyb3210 said:I do have a probably silly question now. But gladstones are asking me to create an account on their website and fill out the PAP. I know coupon-max said NOT to bother with that...

Thanks Keith would you be able to advise if I should contact gladstones by setting an account up or just send an email to their generic inbox enquiries@gladstonessolicitors.co.uk? I feel the email will get overlooked there?
Again a silly question and I probably should create an account but I'm not sure if it will give me an option to send an email and just an option to complete the PAP which I don't need to do
Sorry coupon-mad had a spell of auto correct there haha!0 -
No harm in using their 'account' portal IMHO.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The NEWBIES thread does say...DO NOT use the 'reply forms'. You do not have to declare your finances!
As for 'setting up an account'... why would anyone want to do that?
Just sent your email to their enquiries@ address.

But more importantly... have you advised both Gladstones and NPM of your current address?
The email address for that are:
dataprotectionofficer@gladstonessolicitors.co.uk
and
dataprotection@npmservices.co.uk
respectively.

Thankyou both once again! I certainly will be informing BOTH gladstones and NPM regarding my address.Sorry to be a burden but is there any reason why I should delay my response to the last day or get this email sent asap? The reason I ask is I read that there was new regulations coming 2023? So would delaying this benefit me to hope this regulation come into effect if it goes to court? Also do you have a way to donate money to this forum?0

To answer you last question first, there is no way to donate to this forum, it would not be allowed, and nobody here would accept a payment anyway.
As to your other questions, there is currently a thread about the current consultation regarding parking fees. Your input including the video would be of help.
There is no advantage in delaying anything from your point of view, and in any case you are required to narrow the issues to try and avoid court, so you should send the video now, but should also send it to the PPCs trade association, the IPC, and the DVLA, and your MP.
