I don't suppose it matters but there is an error (probably a typo) in paragraph 12 sub paragraph 6, where it quotes Protection of Freedoms Act 2021

Oh yes, Ithink it also talks about 'reg 4' instead if schedule 4 but that's fine from a Judge.

Question to the Department for Levelling Up, Housing & Communities:

To ask the Secretary of State for Levelling Up, Housing and Communities, if he will outline his planned timetable for the Parking (Code of Practice) Act 2019 impact assessment, in the context of the closure of the private parking code of practice call for evidence on 8 October 2023.

    Answered by
    Jacob Young
Parliamentary Under Secretary of State (Department for Levelling Up, Housing and Communities)
This question was answered on 20th October 2023

The Call for Evidence closed on 8 October and officials are now working through the submissions. The intention is to publish the Impact Assessment together with a consultation on options for handling parking charges and debt recovery fees, to make sure that the consultation is as well informed as it can be.

The Government will publish a response to the Call for Evidence in due course.

I thank him for his continued support on this issue and for his work in steering the legislation through the house. We will implement it in full at the earliest possible moment.

But will that be before the General Election, especially if it's called early?  And if that does come first, I wonder what Labour will do if what now seems a somewhat foregone conclusion happens?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hopefully their Snoredships will not be involved any further as I get the impression that they were well involved in pushing for the IA:-

"Draft Private Parking Code of Practice
    Date laid: 7 February 2022"

"4.We have received submissions from three private parking operators, Euro Car Parks Limited, Parkingeye and the Parking Group, which raise a range of concerns about the draft Code. This report considers some of the key issues raised in the submissions and the Department’s response to them. We have published the submissions and the Department’s response in full on our website.1"

    "Conclusion

26.We welcome that the Code seeks to improve consumer protection in the private parking sector. We regret, however, that the Department has failed to complete its IA, which could have provided a detailed and robust assessment of the expected impact of the changes. This would have been particularly helpful, given that the Department disagrees with the assessment produced by the private parking industry. We are drawing the Code to the special attention of the House on the ground that it is politically or legally important and gives rise to issues of public policy likely to be of interest to the House."

Another consultation!  Why?  We don't need debt recovery fees; if required, they should be incorporated into the overheads of running the business, a point I made during the initial rounds.
