Lowell are a similar bunch of cowboys that my wife once had the misfortune to deal with. They are basically liars, crooks and bullies and the sooner that these Companies are outlawed, the better. I heard all of my wifes conversations, and I'm just glad that she is strong and was able to fight back, they were unpleasant and very threatening. They promised bailiffs within a week, so she asked for details of the required Court Order - Even when caught out they still tried to pretend that they had the law on their side. I only wish I had found this website sooner so that we could probably have avoided paying it. Note to Exel - Not fraud, we have no problem paying what is owed, but I have a real problem in dealing with Companies like this.
As I understand it, they need to be able to provide a copy of the signed credit agreement, a deed assigning the debt to CL Finance, and a full breakdown of the amounts owed. (Please feel free to correct me in this).
It will definitely be worth getting a copy of the original agreement to check out about the PPI, as you may have a counter-claim if this was not requested. It may be worth checking out about PPI on this Forum, as there was a lot of mis-selling, and you may well have a claim against GE Capital - I am no expert on the rules for re-claiming this, but I'm sure that others can guide you. You never know, you might even find that GE are the fraudsters and owe you money.;)

If it were me I would collect all the letters and staements in date order. Write a covering letter, keep it brief and to the point and submit this to the court. I would expect a sympathetic response from the judge, but ..... I've been getting some advice from there too and it sounds like you are in agreement with that Dylanwing, many thanks. Missile - you are right, by my reckoning I was in default by about a pound for a while, and I accept that should have been paid earlier, but talk about punitive charges! Anyway, I really appreciate your posts, and I wish you all a very happy Christmas.0
