Terms and Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the Terms and Conditions and by participating all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Participants should retain a copy for their information.

The Promoter takes data protection seriously. By entering this promotion, participants confirm that they have read the Privacy Policy, and agree to these Terms and Conditions for the promotion. By submitting any information required as part of their entry into the Promotion, entrants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and Data Protection Act 2018.

Eligibility 

1.    Open to UK (England, Scotland, Wales, and Northern Ireland), Channel Islands and Isle of Man residents aged 18 or over, excluding employees and their immediate families of the Promoter, its agents, affiliates, or anyone professionally connected to the promotion.  
2.    No purchase necessary. However, a current, valid email address and internet access required. 
3.    Promotion opens for entries from 18:00 on 27.07.23 and closes at 18:00 on 24.08.23. Reviews received outside of this promotional period will not be included in the prize draw. 
4. There will be one (1) prize draw for a chance to win one of ten (10) prizes.  All genuine/valid entries of an acceptable standard received within the promotional period will be included in the prize draw.  The prize draw will take place within seven (7) working days of the closing date. 

HOW TO ENTER

5.    To enter, entrants must visit : https://www.purina.co.uk/cat/cat-food/gourmet/perle , and follow the link to leave a genuine review for any GOURMET PERLE® product between the stated dates. Only reviews made via the official link will be included in the prize draw. 
Entrants will be required to provide their full name and a valid, current email address. A maximum of one (1) review /entry per person will be included into the prize draw throughout the duration of the promotion. 
The Promoter reserves the right, at its sole discretion, to disqualify any individual found to be attempting to circumvent this clause by tampering with the operation of the promotion, setting up multiple accounts or using multiple identities, or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive. 
Bulk, trade, agencies or third party or automated entries are not permitted and will be disqualified.
6.    Entry into the prize draw is automatic upon completion of a genuine product review (good or bad).  All genuine reviews will have the same chance of winning.  By entering, participants accept that their submitted review is subject to being moderated by the Promoter.  Participants are solely responsible for the content they provide. Such entries cannot infringe the copyright or other intellectual property right of others.  Any reviews that are not relevant to any of the products in the range will be excluded from the promotion.  Any inappropriate, unsuitable, or offensive material will be removed immediately and may be reported to the appropriate authorities. Any such submission will subsequently be withdrawn from the Promotion.  
7.    No responsibility will be accepted for entries which are incomplete, incorrectly completed, not received for whatever reason, or for any technical or other error that may arise with any entry.

Prize Details 

8.    There are ten (10) prizes available to be won in total across all the prize draw consisting of one month’s supply of the GOURMET PERLE® product best suited to the winner’s pet’s weight, age and breed and based on the Purina Feeding Guidelines. The likely quantity will be 3 – 4 pouches per day for one cat for one month but this may vary depending on the winner’s pet’s weight, age and breed. The winners will be able to choose from two variants of GOURMET PERLE, subject to availability including GOURMET PERLE Cat Food Chef Collection 40 x 85g, OR GOURMET PERLE Ocean Collection Wet Cat Food 40 x 85g. The prize will be delivered to a pre-agreed address in one shipment. 

Winner selection and notification 

9.    The winners will be drawn by an independent auditor at random from all valid and genuine entries received by the stated closing date.  
10.    The winners will be notified via email within seven (7) days of the draw. The winners will be contacted using the email address included in their original entry. If any winner cannot be contacted after 14 days of original notification and after three attempts, or is unable to take the prize, they will lose their entitlement to the prize (which will subsequently be awarded to a reserve winner selected at the time of the initial prize allocation, using the same contact options). On completion of the validation process, the prize will be sent by special delivery post or courier, via a tracked and signed for service, within seven (7) days of confirmation of the winner’s address. The prize is as stated and not transferable. No cash or other alternative will be available in place of the stated prize. The Promoter reserves the right to substitute the prize, should the stated item become unavailable for any reason, with an alternative of equal or greater value.
11.    The Promoter reserves the right to verify all entries and the winners including, but not limited to, any entrant’s identity, and to refuse to award a prize or withdraw prize entitlement or refuse further participation in the promotion where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, or any instructions forming part of this promotion’s entry requirements, or otherwise where a participant has gained unfair advantage in participating in the promotion, or won using fraudulent means. The Promoter will be the final arbiter in any such decisions, and these will be binding.

General 

12.    By taking part in the promotion, the winners acknowledge that the Promoter may contact them to ask whether they want to participate in marketing activities/PR relating to this promotion only. Winners are not obliged to consent.
13.     By providing an entry, participants grant the Promoter, its associated companies and agents permission to publish, use, reproduce, distribute, make available, edit and/or modify the entry in any way (in whole or in part) for all commercial, advertising and/or promotional purposes in perpetuity throughout the world and in any media, including without limitation on packaging, advertisements and/or the internet and they agree to waive any moral rights to such works.        
14.    Subject to the Promoter’s Privacy Policy which can be found at Policy https://www.purina.co.uk/privacy, the surname and county of the verified winners will be available upon request by sending an email to: petcareteam@purina.nestle.com with the subject line “WINNER’S LIST: GOURMET PERLE RATE AND REVIEW PRIZE DRAW” for a period of three (3) months following the end of the promotion. The Promoter reserves the right to refuse any or all such requests. When contacting this email address, your request will be actioned in line with Nestlé Purina’s Privacy Policy. If any winner objects to their information being published, then they can contact the Promoter by emailing: UKI.Dataprotection@uk.nestle.com with the subject line “WINNER’S LIST: GOURMET PERLE RATE AND REVIEW PRIZE DRAW”.  We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. 
16.    Limitations of Liability: Neither the Promoter nor any associated agencies assume any responsibility or liability for: 
a. Any incorrect or inaccurate submission during the registration process, or for any faulty or failed electronic data transmissions. 
b. Any unauthorised access to, or theft, destruction, or alteration of entry at any point in the operation of this Promotion. Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Promotion. 
c. Inaccessibility or unavailability of the internet, or the website, or any combination thereof. 
17.    Regretfully, the Promoter cannot be held liable for system failures on the website. 
18.    The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
19.    Conduct of Entry: Entrants of the Promotion agree to be bound by these Terms and Conditions. The Promoter reserves the right at its sole discretion to remove any entry by an individual found to be tampering with the operation of the Promotion, or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive. 
20.    The Promoter’s decision is final and binding in all matters. 
21.    All participants will be required to provide a genuine email address that is personal, valid and accessible throughout the promotion. In the event that the specified information is not provided or is incorrect or an alias, the entry may be considered incomplete, and the Promoter reserves the right to invalidate the entry.
22.    In the event of an email address becoming inaccessible during the promotion, the Promoter is not able to retrieve and amend any existing entries to a new email address. 
23.     All normal internet connection charges associated with the submission of an entry to the promotion shall be the entrant’s responsibility.
24.    In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these Terms and Conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment 
25.     If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
26.     The Promotion and these Terms and Conditions will be governed by the laws of England and Wales but any disputes as to the meaning of these Terms and Conditions will be subject to the exclusive jurisdiction of the participant’s local courts.  
27.    Data Protection: The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent and you have opted-in to receive future marketing communications or prize PR. As part of this promotion, if you are not opted-in into our general marketing email, you will still receive emails for this promotion only to let you know if you have won and to make arrangements for the delivery of your prize. The surname and county of the verified winner will be made available as set out above and the winner can object to this by emailing UKI.Dataprotection@uk.nestle.com. Otherwise, your personal details will at all times be kept confidential, and in accordance with the General Data Protection Regulation (GDPR).
