POPLA no email response

Hi all,
Having read through many threads, I cannot find one that matches my situation. I found this site after I had already appealed my Parking Charge from Initial Parking (11 Jan 23', Seel St, Liverpool), and therefore did not use the standard letter/text provided for Newbies. They rejected my appeal and sent me a POPLA code, which I completed and submitted on 07th Feb. I received an email from POPLA on 07th Feb informing me my 'appeal is now ready to be assessed and is in a queue. We expect to make a decision on your appeal within the next 2-4 weeks. The next communication that you will receive from us will be the decision on your appeal'.
Completely forgot about the appeal, no emails or letter communication was received from Initial Parking or POPLA. Then, I received a Debt Recovery Plus letter on 19/05/23 stating that I could either pay in full (£170) or it would be classed as 'Intent not to pay'.
I did not respond to the debt recovery letters (still ignoring them three letters in), however I did email Initial Parking to explain I had not had any communication from POPLA regarding my appeal and therefore shouldn't have been send debt recovery letters. They responded and said that POPLA did issue the outcome and that my appeal was declined. I then logged into my POPLA account and saw that they had declined my appeal from Feb.
So my question is- since I did not receive any communication from POPLA, am I accountable to the debt collection agency? Can I appeal with POPLA since I had no communication on this? Given their email on 07 Feb said 'the next communication that you receive from us will be the decision', I assumed they would be in contact with me. No where did it say it was my responsibility to check.
[Further, Initial Parking had refused to provide me with evidence of landowner contract- can I also argue this in my appeal? I did contact the landowner (private land) but he's clearly more interested in the money].

Ignore DRP, they are powerless debt collectors - please read the NEWBIES FAQ Announcement, fourth post, about ignoring them. Come back on this thread if you receive a formal Letter Of/Before Claim from Initial Parking's solicitors or a County Court Claim via the Northampton CCBC.You could write to POPLA and ask them to confirm what their decision was. If they state they turned down your appeal, there's nothing you can do now about that. It does not mean you pay the PCN, only a judge can tell you to do that. If you get anything other than confirmation of the rejection of your appeal from POPLA, come back for further advice.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hope you have not contacted DRP, they are just timewasters and money scammers.

Regarding POPLA, you could complain to the BPA saying you now have a debt collector chasing you when POPLA failed to respond.
POPLA, DRP and Initial Parking are all part of the scallywags club. It is the BPA who approved the great add-on scam which in itself is a load of rubbish

So my question is- since I did not receive any communication from POPLA, am I accountable to the debt collection agency?That's not the right question. Sounds like you are taking the debt crawler a bit too seriously! You must NEVER pay a Debt firm whinging about an inflated £170 PCN 'debt'.
Search the forum for £170 ignore. Everyone ignores them! Laugh at the scary (NOT) demands.
Come back if you get a court claim but Initial don't sue people. No worries, even if they break the habit of a lifetime and try. No problem, no risk, no CCJ: we defend and win.
But also come back in August please, to take part in the Government evidence Consultation (connected to the imminent publication if the DLUHC's draft Impact Assessment to regulate private parking rogues).
I expect you will be very angry about this scam by then (after a few letters) and will want your voice heard to change the law for good.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I'm actually in the same boat as you. I sent mine Feb 25th and was told 2-4 weeks for a decision. That was last Sunday and I haven't heard anything. I assume POPLA must be backlogged at present.0
