Premier Parking Solutions Ltd appeal

Hi all,

I had a parking charge notice recently after returning from holidaying in Cornwall.

I parked and payed at the machine but only entered the first letter of my registration number for some reason or another.

I was in belief that because I had paid it wouldn't be an issue and did the initial appeal which was denied.

I then followed instruction provided by PPS Ltd and launched an appeal with IAS, which recently has also been refused on the grounds of entering a contract with PPS Ltd and not the terms of parking were breached.

Unfortunately I started looking further into the ins and outs and do's and don'ts once I had started the IAS appeal, especially looking through this forum. I quickly realised I had gone about things in the wrong way from the very start.

Now I'm just wondering if it's too late to go down the popla route and if it's maybe too late to do anything but pay whatever it is I am asked to pay at this stage.

Any help with this would be great and much appreciated.

    POPLA and IAS are two different (supposedly) independent appeals services, depending on which ATA the PPC belongs to. In your case, the PPC was an IPC member, meaning they only offered the kangaroo court of the IAS appeal. You cannot do a POPLA appeal because the PPC is not a member of the BPA ATA.

    So, you have exhausted Plan B and Plan C. Did you try Plan A? Complain to the landowner and write to your MP about the scamming behaviour of the predatory PPC.

    Plan D is a county court claim which is where the real arbiter, a judge, would decide whether you owed a debt to the unregulated private parking company. Most cases never get to a hearing because tey are discontinued by the claimant as they realise that you are not a gullible fool who poops their pants at the mere mention of "CCJ" and "bailiff".

    You must read the Newbies/FAQ thread which explains the whole process. Unless you try Plan A, you will have to weather a storm of useless debt collector letters until/if the PPC decides to file a claim against you.

    How would I find out the land owner to complain to? And would I be writing to my local MP?

    They are members of both but they are only accredited by the IPC, hence the IPA appeal.

    Google is your friend when it comes to finding out who the landowner is. What was this site? A car park for an organisation? A car park for a number of shops/businesses?

    When complaining to your MP, that means your MP. You could ask them to contact the MP of the constituency where the PCN was issued to you, if different.

    Write to  your local MP.  He/she is responsible for representing you. Ask them to inform the MP covering the area in which the car park is based, about your issue. 

    SOME IDEAS ON DETERMINING WHO OWNS THE LAND 

    1. Google searches
    2. If a retail park, check on any signage which lists the on-site outlets
    3. Ask retailers on the site if there is a managing agent
    4. Ask retailers on the site to whom do they pay rent
    5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)
    6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information 
    7. Contact The Land Registry and for around £3 they should be able to provide definitive detail
    8. If you haven't already done so, give us the name of the car park/site/location, we may have seen other cases there.

    It is a small car park in Mevagissey, Cornwall, provided to park near to the town/harbour.

    Just ignore all the £170 demands but come back in 2 weeks to voice your wrath and show your evidence in response to the DLUHC's imminent draft Impact Assessment.
