    Hi all, thanks for the comments, we have got some good legal advice and yes, we have done nothing illegal and would never do this, always  having the best interest for the elderly relative. This issue is really tough and we are trying to fulfil the wishes of an elderly person the best we can. thanks again

    That wouldn't be the case for your Universal Credit claim. Owning a property that you don't live in will be classed as capital and you need to report this. Not reporting it is benefit fraud and DWP will catch up with you at some point.
