Britpark fine BWlegal

Hello, my husband recently received both a parking fine and a final notice for non payment of car park fee on 9/5/2023.  He received both letters together and the date for appeal was already passed by the time he opened them.  My husband did pay his parking fee for this day, so I sent an email to britpark to explain this.  They ignored my correspondence and escalated with BW Legal who have now sent a bill of £170 for a parking fee already paid.

I called BWLegal and explained we had paid and he asked me to send through the proof of payment.  I sent a photo of my husband's credit card statement and by chance, the paper ticket from the day he found in his wallet.  The ticket is poor quality and the ink has smudged in places, but you can read the date and the time and part of the number plate.  I would have thought this was enough evidence that we had done nothing wrong, but unfortunately they say there is no sufficient evidence and we still owe the £170. Criminal.

Could anyone advise where we go from here?  We could just pay the fine in order to put this to bed, but why should we?  We have done nothing wrong and this is bad business.  My husband has been sent incorrect fines before when he has already paid.  

I am also furious that they need not provide any evidence that he didn't pay, but we have to prove our innocence.  Also how is it legal to obtain our personal details from DVLA without proof of a crime?  Surely this is not right?

Any help appreciated.

    It is not a fine.

    Plan A is always for the keeper to complain to the landowner and their MP.

    Never, ever 'phone a parking company or their agent.

    Send an SAR to the DPO of Britpark to flush out the original PCN. Include a copy of non-photo ID with the request.

    Check that the details on the vehicle V5C are correct and up to date, especially if you have moved home since or just before the date of the alleged event. Don't assume, go and dig out the V5C as this is the most common reason for not receiving the original PCN.

    Since you are past the appeal deadline there is nothing else you can do unless/until you get a Letter of/before Claim or a court claim.

    Dont think of BWL as the lawyer you'd expect when speaking to one. They're nothing more then cowboys/thugs pretending to be lawyers. They're hopeless. Nothing is going to 'satisfy' them, they want to simply scare you into paying more, with threats of courts and CCJs.

    Think of BWL as a scam, thats all they're trying to do, is scam you for more money.

    Do not pay the fine. 

    I've seen it lots and I'm not a regular, and I've also been through it first hand. They will threaten you and threaten you, right up until about a day before the court hearing then they commonly drop it, with the help on here they dont stand a chance. 

    It sounds like you'd easily win this. Dont allow them to pressure you into paying.

    It's not a crime or offence.  You are not in trouble or at risk of a CCJ, and this is easy to handle.

    You haven't had a 'fine' or a 'bill' and you won't be paying.

    Does the ticket show a typo in the VRM?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
