EV charging at service station - PCN

Hello all,

So lucky me I have two PCN's I'm currently disputing. And to be honest I'm on a break down over it haha 

I've had a PCN come through for staying 30 mins over the free 2 hours at MOTO Doncaster. I'm appealing on the fact that it took me a while to park and to exit due to it being busy, and that I had to wait to charge (gridserve) as there was only one charging port there. The signs directly behind the charging spaces that you would see from the vehicle were completely blank - so I am hoping I can contest that as well from a signage POV.

The parking allegation was on the 1st June but this was not received to the hire company til the 22nd and then to myself on the 24th via my place of work - so can I contest using POFA? I don't fully understand the wording of scej 4 and how to put it into the appeal.

But what I am wondering is - can they enforce charges for people parked in EV bays, surely these bays are leased to the EV company and therefore cannot be enforced by a seperate company other then Gridserve? Can I use this in my appeal?

    Use Edna_Basher's Lease/hire car appeal near the end of the first post of the NEWBIES thread.

    Don't write your own appeal about the story of what happened but you should add a paragraph, stating that the driver was using the EV charger and not only is this not 'parking' in the car park but no CP Plus contractual signs are visible at the EV bays.  Proof of charging is attached as evidence. The driver 
    will not be named so don't send a begging letter.

    Technically no I haven't done a first appeal as I couldn't get to that stage. Going through online it says it's been reissued and therefore the reference is no longer valid, to email through an address provided. I did this, it was very informal mainly just asking what to do since I can't seem to do the online appeal. I never received a response. So I'm not sure whether to do a first appeal through the email address, to go straight to POPLA, or to complain to the company. It's all lovely and complicated. 

    Thank you I will look at the Edna Basher appeal.

    You can't go straight to POPLA and can obviously only appeal a NTH once you get one in your name.

    Or is the NTH already in your name?

  • Nope it's still in my company's name - says Issued to 
    'My company name
    c/o the hire company'

    But when I go onto the website to appeal it says '

    Your PCN has been re-issued

    We can confirm that this reference is no longer valid as liability has been transferred and an updated Notice has been issued. If you need further assistance, please email appeal@appealpcn.co.uk so that our team may assist you directly.'

    Did your company already reply & name you and give your home address as the lessee?

    No they forwarded to me and I sent an email but haven't received a response. Just a further notice to hirer which is also in their company name
    So either:

    (a) your company must respond saying you were the lessee and provide your full name & address, or

    (b) your company must trust you to appeal for them but that way they remain liable.

    Which do that want?  Is your Fleet Manager new to this?!  Why didn't they just do (a) which the lease firm did?  That's what they should do to transfer it to you.  Same process.

    They can't just send you a copy of their notice!

  • Can't they? Ugh. I don't know in all honesty. I've had two parking fines - the fistral beach and this one. They've both been sent to Arval then forwarded to my work secretary with the company name on it and she's just forwarded the PCN's to me. I'm guessing so I just pay it but I don't want to ha
  • So should I be going back to my company to get them to hand my details over as the hiree? Or just appeal it as the hiree?
