Section 75 Time limit of 1 year ?

Tried to get a Section 75 Claim through Halifax but was told it was only a 1 year thing. I did argue that regardless the product was failing since just after 1 year and the company fobbed me off then and again last week. It was a sofa with faux leather ( I did not realise at the time ) but started to de laminate badly. It does loudly state it has a 100,000 rub count so if your'e up to it that's 92 rubs every day for 3 years ! It never got to that level of use. It was bought in march 2021 but I complained in 2022 and got fobbed off then so I wanted to pursue this as far as i can. Thanks.

There's no time limit for making a S75 claim, are you perhaps getting confused with Chargeback?Do be aware that if you wish to make a S75 claim, it's fairly common for you to have to pay for an expert report to confirm that the item is not of satisfactory quality - the cost of this would be reimbursed if your claim is successful.0

As above, the call handler may mistakenly think you were claiming a chargeback, as there is no time limit to making a claim under section 75 consumer credit act.

Your bank has a legal responsibility to help you under this section of the act.
Either phone or write to your bank again, asking for a section 75 claim form, and do not be fobbed off again.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
