environment search was not done by solicitor in 2002..

we have an issue as mentioned in previous postings about our house. when i bought i obviously asked our solicitor to do the conveyancing on this and all seemed to be fine. now it appears our solicitor did not do an environmental search though according to the law society this would have been something they would recommend to solicitors to do. so my questions:

1) why would our solicitor not have done this? was it or not compulsory?
2) we were told on by our council on what is a local search that all was clear . i think if there was any doubt whatsoever i would not have bought here.

apparently we are on landfill which is rubble from the second world war and apparently not hazardous but apparently no-one told me anything about this . the golf course down the road has had some landfill which was not regulated but then i would not understand why the council would allow people to play golf.

i have tried contacting the council and now realise i need to put more pressure but this is taking up all of my time.

what do you suggest i do? thanks

    I don't believe it's compulsory as when I bought this property it was an optional extra that I had to let the solicitor know if I wanted him to carry out.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    I bought in 2000.
    I never heard of an environmental search at that time.

    searches that could be done. apparently the law society recommended from 2001 these to solicitors. buyer beware not to trust everything you get /hear from the solicitor on this basis then i would say.

    The report is at the solicitors discretion. Local solicitors will be in a better position than call centre ones to know if one is necessary. Pointless having one and paying for it if you dont need one.
