Hi guys

Just a quick couple questions - I am well versed in fighting these vultures and have done so over the years successfully.

Our terrible freeholder decided to get PCM UK to "look after" our property, much to the chagrin of all the residents.

Now I know the process and have re-read the relevant threads etc. I will wait for the NTK and go from there etc

However, one thing that has really irked me is that I got a ticket for parking in my own garage (!????), with some part of the car not in the garage as my garage door was broken. To compound this, their parking attendant entered my garage (still my personal domain even if the door is up?) and put the ticket on the windscreen. Some items were also not where they were initially, so it looks like the attendant decided to re-arrange items in my garage to get to the windscreen.

Is there grounds to lodge an appeal due to the above scenario to nip it in the bud or should I just follow the usual process?

    Your thread title says PCM UK.

    Then you mention UK CPM.  They are two different ex-clamper firms.  Which greedy unreasonable ex-clamper idiots have been inflicted on you?

    Appeal won't work.  Nothing will 'nip this in the bud' now that the residents have allowed this to happen.

    This was how to stop it; maybe you all still can.  
    The residents got PCM removed and the signs were covered before they started!

    Signage went up a month ago but I will endeavour to speak to other residents, and try and get them removed.

    What does your lease/AST/property rental/ownership agreement say about parking, parking companies, parking charges, and court? Does it include the standard clause about resident's rights to quiet enjoyment?
    What it doesn't say is equally important.

    If you are a tenant, was a ballot carried out in accordance with the Landlord and Tenant Act 1987, Section 37? Without it, and a majority vote in favour, a tenant's lease cannot be varied or amended.

    Plan A is always a complaint to the landowner and your MP. You should also ask when (not if) a ballot in accordance with the above Act was carried out, and what was the result.

    Your lease/AST etcetera has primacy of contract over anything an unregulated parking company that was not a party to your residential contract has to say. They are not offering anything that you do not already have, therefore there is no offer, therefore no contract, therefore no breach of contract, and they cannot take away your existing rights.

    PCM UK, you mean Parking Control Management UK Ltd? They are well known for teaming with management agents and harassing residents most of the times for no reason. 

    Did you robustly complain to the freeholder and the property management? Sometimes writing to the agents only is not enough. Is the landlord authority in order, on this contract with PCM? I think as a resident and service charge payer you have the right to ask to see it.
    Complain to your MP reporting word by word the naughty way PCM works, as you did to us. The MP should complain to them about it and ask for immediate cancellation.
    PCM is well known to normally dismiss even inquiries from MPs, not answering the questions and eluding any topic not convenient for them. They normally send a polite rejection letter with an indication to follow up with IPC. MPs usually proceed with it in good faith, only to receive another bounce letter full of the usual nonsense sometimes directly from the address of notorious Will Hurley.
    We should involve MPs the most we can, considering the Government's intention to end unfair practices by PPCs.
    Your appeal to PCM might be rejected, but if you make a lot of noise, they might confirm they "will no longer be pursuing the matter and the parking charge has been cancelled" ad IAS appeal stage. That happened to me and I was not expecting that, knowing the reputation of IAC&IAS.
    I don't know if you have received already a NTK, if this is the case a SAR to DVLA can be sent to check if PCM collected keeper data at the right time and not too soon.
    The signage is acceptable? The terms and conditions have been well explained? Any breaches of PoFA 2012 or IAC parking Code of Practice?
    All in all, my opinion is that they have a weak case and this charge will be discontinued if you build up a big thing complaining about this to everyone.

    I have received the NTK - I am about to send the standard response.

    Do I include the parts in bold? Both? Excuse my stupidity....

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    I replied to their NTK and they replied, basically rejecting it etc etc.

    They did say "this is a standard response from the internet and has no merit" or something along those lines.

    I assume now I just hold fire until I get the LBC? Just wanted to check...
