Private parking ticket

In September 2022 my partner was issued with a parking ticket for staying in the hotel car park as he forgot to register the vehicle the one day, when he had the ticket he was still a guest so he took the letter to the receptionist at the hotel who said they would deal with it and not to worry as he was a paying guest, the fines were issued to no guest who tried to park in the car park. He heard no more from the parking eye fine and assumed the hotel reception had dealt with it like they said. 8-1/2 months later in June 2023, he recieved a letter from a debt agency who said it had been passed onto them, they are demanding £170, they are not interested in anything we say even showing them proof of stay at the hotel as they said he had past the deadline to appeal, however he has had no contact from them demanding payment or advising there was a deadline to appeal, had he had known this he would have appealed in the time frame and sent the proof of stay and the matter would have been resolved, they just keep asking for paymment and say if he doesnt pay then they will ask their client how they want to proceed, shoould he hold off paying?.

    Hello and welcome.

Get back on to the hotel to get this thing cancelled.
Remind them that they agreed to do that last year but failed.

Hi Keith, I went back to the hotel last week and also copied them in on my eamils to the debt collectors, all they did was email me saying.

"Back in September last year we had a Parking Eye system where you entered your registration into an iPad on reception. Now we have a different system operated by Your Parking Space. It is with deep regret that we are no longer able to help assist guests who received a fine from Parking Eye. At the time we would have notified guests how to appeal the fine and the fine would get cancelled. Unfortunately as so much time has passed it looks like the fine you received has gone to the debt collectors.

Replied back and said your receptionist gave no information on how to appeal just said than not to worry he would sort it for him....Had no response back at all.

Is the 'debt agency' DCB Limited?

Just had another letter demanding money regardless of us sending them proof of stay at the hotel, said cannot appeal as too late, if we want to dispute it then it will be in court and we can end up with extra charges  and CCJ against him

Ignore anything from DCB Limited. Come back on this thread if you receive anything from DCB Legal - anything from them will need attention.

Thanks for the help … I’m hoping they won’t take it to court as they have as much chance of losing as we do as we have sent them the proof that he was a guest at the hotel and we would have sent that  earlier with an appeal if the hotel reception hadn’t said they’d deal with it.

That's not true. And you'd win anyway.  You WANT DCBLegal to file a court claim!

That's when it ends, as long as you defend it.

We really mean it. Get your MP to complain to the Hotel & parking firm and lean on them on your behalf. You've presumably read the sticky threads and learned that this is a current Parliamentary issue and that MPs must be lobbied...

...and that you are needed within 3 weeks to join us for the vital Public Consultation?

This is literally said every day on the forum this month - on EVERY debt collector and LBC stage thread you read - and the background to the new law is fully explained in the top sticky thread by MSE_JC.

Please read it and bookmark it.

See you back here in August. It is vital.
