Cheque not signed - what can I do?

    Many a mistake made in early January with this.

    Quite right. But there is a generally accepted moratorium for the first period of the New Year, on that aspect.

    ......sole problem is - the Banks never seem to agree between themselves as to whether its the first 7 - or 10 days!
    If you want to test the depth of the water .........don't use both feet !

    Didn't work quite like that (in the days when the banks checked details on every cheque) - the Bank has a record of when the cheque book was issued to the customer and unless the customer had been using the same book for over twelve months it was held that the customer must have made a mistake as they couldn't have issued a cheque in January 2007 if it was out of a book that wasn't issued until September 2007

    So, you can only make a mistake with the year in the early days of Jan .. if your cheque book is at least 12 months old? Thought I'd heard most of them, Mark, but that is a new one on me.

    People who process cheques in bulk have, since at least '85, had an arrangement via their clearing centres and outwards to all the Bank / BS reception points ..... that cheques will not be returned by virtue of the wrong year in the early part of Jan. I know that has always largely been successful .... the only uncertainty ever being that some agreed 10 days whilst others agreed 7.

    But (probably just cheques over the counter?) I've never heard that the age of your chequebook was ever a factor in forgetting the year change. Could only ever have been dreamed up by a Bank.;)

    I think the point Mark was making that if the cheque book was only issued in Sept then the chances of it being a genuine mistake (and not a fraudulent attempt to cash a year old cheque) is more likely - as they are legally only valid for 3 months

    Correct, but it is 6 months. And to be honest, the bank need not check to see when the cheque book was issued and often don't. Cheques are not reviewed in that level of depth unless the bank does not wish to pay it.
