Warranties and returns

Hello, I  have an (expensive) item that was returned to the manufacturer and repaired whilst in warranty. The  same fault developed again shortly after warranty expired, do I have a case for arguing that it should be repaired/replaced? The fault makes the item’ not fit for purpose’.

    Your consumer rights are with the retailer rather than the manufacturer, so was the repair initiated via the retailer (under the Consumer Rights Act) or directly by the manufacturer as a warranty claim?
  • The manufacturer is a retailer too.
    I bought the item via a franchise, but went directly to the brand company/manufacturer for the repair, which they accepted.

    It sounds like you went to the manufacturer for a warranty repair then, which means you should act within their T&C for remedy.

    Alternatively give some more detail on timescales and you may get answers as to your Consumer Rights.
  • I have done a bit more research and think my question does relate to consumer rights.
    The item was purchased nearly 7 years ago and was repaired 3 years ago, under what the company have stated was a warranty.
     I am very disappointed with the quality of this item which I purchased as along term investment.
    I understand that I can consider taking this to County Court but there is a 6 year time scale - which has now passed. Does the fact that the fault is the same as 3 years ago and that the manufacturer acknowledged and attempted to repair mean I have a case?

    No, it does not.

    So your claim would be against the franchise, if there was one.
