CEL PCN

I received a PCN from CEL between Christmas and New Year 2022. I appealed a couple of days later. My appeal was based on the fact that I did actually pay although it was about 25 minutes after entering the car park because the App was playing up. I use the car park regularly and usually pay for the week, which I did on this occasion. I can evidence previous and payments since this date.

I heard nothing back from CEL although about 3 weeks later (January 2023) they sent me a chaser letter re the outstanding PCN.

I got in touch with BPA (who were useless) but they did contact CEL who advised that they did respond to my appeal. They allege to have done this about 10 days after receipt. I did not receive anything. When I pressed BPA who went back to CEL, CEL advised that their response was emailed but they do not retain the emails as they use a shared mailbox! So they can send chasing letters my post but not a response to my appeal? CEL provided an email 'send' receipt but in my opinion that evidenced nothing. Most importantly here, I did not have the opportunity to go to POPLA because I did not receive an Appeal response.

I sent a letter to CEL by recorded delivery to outline how they have failed to follow their own code of conduct (on website) and that of BPA. I heard nothing back.

Next up were the clowns that are DCBL Ltd. They are now chasing me for the debt.

I know I probably shouldn't but I was really annoyed by the conduct of CEL so (via their website) I messaged DCBL to advise that the amount was in dispute and their client had failed to adhere to the respective compliance/code of conduct. They messaged back with attachments which were from CEL. They included an appeal response (first time I had seen it) and a response to my letter, whereby they agreed to reduce the sum from £100 to £60 but gave 14 days for it to be paid. As I never received the letter I obviously didn't have the option to pay whether I wanted to or not as I was seeing this letter for the first time and we will well over 40 days.

Now I have the appeal response, I tried to go on POPLA but the reference is no longer valid. BPA were not helpful so, I am a little lost what to do next.

One final observation of the first letter CEL sent to me and it may be nothing but, where it details the 'incident' it states the date, location, terms and conditions of parking plus a 'from' and 'to' time and date. I paid within the period stated ( for example it says 9am to 5pm) albeit 25 mins after the 'from' details. However, It reads like they are charging me for not paying for that period of stay when, I can evidence I did??

Any thoughts or observations on this would be welcome.

    Just ignore the £170 demands.  You are taking the bait of a scam and don't need to.  Stop responding unless you move house or get a Court Claim form.

    We need you - as a genuine PPC victim of aggression, sharp practice and an 'extortion' attempt to add £70 - to respond robustly to the Public Consultation on the level of parking charges and banning of the false added DRA 'fee' that too many honest motorists currently fall victim to.
