Hello again,
Since my last post, we sent off the defence, filled out the DQ.
Today dad received an email regarding mediation, and we need to reply within 4 days.
I was confused as from reading this forum, I know that mediation is a big no- I then realised I made a mistake in the DQ and ticked 'yes' to mediation in box A1.
Do we now need to send an email back saying we don't want to attend the mediation appointment? Is there a template email available anywhere to use?0 -
Small update: So our case has been transferred to our local court. However we received a letter today stating that our DQ has been 'misplaced' and we need to send a duplicate copy to the local court by post. I don't understand how it could have been 'misplaced' when everything was sent via email? Surely we can just email the DQ to the court (CCing in defendant for proof) instead of paying for postage?0

So we have received a court date for 31 July, giving us plenty of time to prepare a WS. I originally planned to attend the hearing with my dad as a lay rep so that I could speak on his behalf (given that I have written the defence and done all the work so far), however I'm going to be abroad on this date and therefore not able to attend. I couldn't put this date on the DQ as I have planned this trip since we sent off the form (I just hoped they wouldn't arrange a hearing while I was gone
) How easy/hard is it to change the hearing date? Or would it be easier to just prepare dad for what he will have to say in court and let him go on his own- English is his second language however he speaks it well nevertheless and I'm not worried about him being able to express himself if I explain everything and prepare a skeleton argument for him to use on the day. Does anyone have any advice about potentially changing court dates or shall I just leave it and let dad (defendant) go on his own? 0 -
DCB Legal will discontinue anyway so say nothing about the date. Carry on as normal and they will discontinue before the date they have to pay the hearing fee.

DCB Legal have sent a 'without prejudice' email offering £250 to settle the claim- the full amount claimed is £582.92. Have told D to not respond to this email or any other future ones/telephone calls. Hopefully this is a good sign that we're on track to a discontinuation (which I wasn't sure we would get as it's a multiple pcn claim) I've also just noticed that on our hearing allocation letter the deadline for the WS is 15th April- not sure why it's so early when the hearing is set for July? I will start working on it soon though and post here for proof reading when ready1

Seems like Secure-a-Space has not been reading this forum, especially the famous DCBL DISCONTINUATION thread.
