Troublesome beneficiary - help!

I am dealing with a troublesome beneficiary. Given the right to reside in property for fixed time period undef will after deceased died. Fixed sum payable to him under will. Time is now coming up but benrficiary gone AWOL. Also left the house in a filthy state and left a lot of personal belongings, which i cant easily move.

Can i charge the benefuciary storage for the possessions? Can i legally throw them out? 

Also can i deducted the cost of getting professional cleaners from the monies owed to him under the will?

    are they contactable at all - how are they going to receive the bequest from the will ? sounds like they wanted to cause you some grief.

    Have been up until now so do have bank details to make the transfer. Wanted to cause me grief is an understatement!

    sounds like time to get a quote for the cleaning and quote for disposing of the rubbish and then send them the bequest minus that amount and wait for the fireworks - then they can either come back and sort it themselves and get the extra money or accept that they have to pay for it

    I honestly don't know - you would definitely need to clarify that. Can totally appreciate not wanting fireworks, presume this individual has been very trying in the past and has worn you down (that is what they do).

    Reckon that would be the best solution but means more cost I assume?  Have you had a solicitor involved?

    Ultimately you are not, not giving them the whole bequest - just withholding some to cover their bills

    You have to be very careful here get it wrong and you could find yourself on the wrong side the law. The laws are likely to be similar to those for landlords, so you are likely to get better advice over on the housing board where there are several landlords who a fully up to spend with the laws related with taking back possession. 

    Has the beneficiary already had their lump sum?

    No not yet, and wont be getting it until he returns ie not AWOL.
