Thinking of taking evri to small claims court

Hi, i sold a phone on ebay 3 weeks ago and sent the item same day with evri. It still haven’t been delivered to the owner.
All it says we got your parcel on tracking. I requested a call couple of times but nothing. Online chat doesn’t help as its not a human so it doesn’t go anywhere!
Can i take them to small claims court?

Did you take out compensation for the delivery?

You can take anyone to small claims court. Whether you have a chance of winning depends on a lot more detail.

Better off emailing the CEO office (contact can be found on the CEO email website).
If you had compensation and phones are covered they'll likely cover the cost if the parcel has disappeared.

A bit early to be thinking about court.
Going to court should be the last resort, after you have tried other remedies without success. If you do decide to go to court you will be expected to go through the civil procedure pre-action protocols first. If you don't you risk having your claim struck out before it even gets to court.1 -
What was the sales value of the phone? And did you purchase the relevant additional cover to match that value? That might influence what you might be able to claim for depending on what you paid for.

I think this could be difficult.
Evri couriers are not employed by the company (they are just a self employed person that gets paid per item delivered) i wonder what the small print says relating to non-delivery of goods etc etc etc - are you suing that private individual or the Franchise company ??
