PCN challenge on loading bay
Options
Hi all,
I have received a PCN for parking in the loading bay. Can I please get some expert advise if I can challenge on either or both grounds?
1. No observation period. The ticket was issued between 12.07 to 12.07. I tried goggling but I wasn't sure if loading bay needs observation period for pcn to be issued.
2. Wrong car make. My car is clearly a MG and not Audi. Again I have read cases where people say car make does not matter but also read some successful cases if the appeal officer is lenient.
Is this case worth appealing or would it be 65 quid flying out of my pocket?
Thank you
William

The sign says "Goods vehicles loading only."
Is your car (whether an Audi or MG) a goods vehicle?
Is the photo provided by the enforcement officer of your MG car or an Audi?
If the enforcement photo is your car and the car is not a goods vehicle, then IMO, this is one to get over and done with as quickly as possible at the reduced charge.

Why would an observation period be needed? Was your car likely to turn into a goods vehicle while the CEO watched?0

I checked but could be wrong.
From the council website it says you can load or unload a personal or commercial vehicle?
_____________
If you want to load or unload a vehicle, some of the usual parking restrictions do not apply for a certain time period. You can load or unload a personal or commercial vehicle:for up to 40 minutes on a single or double yellow line at any time unless there are yellow kerb markings (indicating a load ban or loading restriction)for up to 20 minutes in a bay that usually requires a resident’s permit, a business permit or a pay and display ticket0 -
Were you loading or unloading ?
That is usually confirmed by seeing someone taking goods out of a vehicle or putting them in as opposed to someone parking, which is what you said you did?

It's by a proper council and you're not a goods vehicle nor can you presumably prove you were loading/unloading goods.
I'd just pay it with the 14 days and take it a lesson learnt.
