But if you hadn't they would have had to or petition your BR. Creditors on the whole don't, yes they kick off, yes they tell loads of lies but if you have the strength to hang in long enough they back down. I held on for as long as I could possibly....Barclays in the end said they would start BR procedings against me & that was for just over £6,000 they at NO time showed any signs of backing down. In the end I decided BR was the only way out and petitioned myself before they did..i'm still not proud of what I did, I struggled on for many many months paying all my creditors off just on benefits leaving me with next to nothing every week left to live on..but the bills always got paid..thats how I had been brought upWe all die. I think I will wait and see what HSBC do; if they hassle me continuously I will save up and take the plunge and declare myself bankrupt. There is no way I am going to get tied to them again.:eek:
HSBC were also one of my creditors, although they did not petition for my bankruptcy - that dubious honour was left to HMRC.
HSBC did, however, make things extremely difficult for me. When I began to experience problems, I made the fatal mistake of going to HSBC, with whom I had been banking for over 25 years, and asking for help. The 'help' they gave me was to withdraw my overdraft facilities on both my business and personal accounts, to 'cancel' my credit-card, 'bounce all my direct-debits and to pass the 'debt' that this created to their in-house debt-collectors, who 'harrassed' me non-stop for immediate re-payment.
They did, also, threaten to put a charge on my house, but this was preceded by my bankruptcy. The amount that I 'owed' HSBC - £8,000.00.
I think that HSBC is most unlikely to petition for your bankruptcy without having first 'milked' all of the other options to death.
To petition for your bankruptcy, HSBC would have to pay the Court Fees (£590.00) and the associated Solicitors' costs - this could mean up-front costs, to HSBC, of over £1,500. There would be no guarantee of HSBC 'recouping' these costs from your bankruptcy estate and HSBC would receive no preferential treatment over any of your other creditors when the proceeds of your 'bankruptcy estate' were distributed by the Official Receiver. In fact the only person to have 'first call' on any funds generated out of your bankruptcy would be the Official Reciever, or Trustee, whose charges are deducted before the 'estate' is distributed. These charges can, often, be £10,000 or higher.
HSBC know this - they also know, by virtue of the fact that you are in an IVA, that you have other creditors. I doubt, very much, that they would take the risk.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

I found HSBC very keen to negotiate but we did owe them a considerable sum of money, so perhaps the less you owe the more awkward they are to deal with.
I agree completely with you about the prospects of them petitioning for bankruptcy; I would say almost definitely they won't, for all the reasons you've outlined.

We're at our daughters this evening so will have the chance for a drink before you, but I do miss not being able to sneak a quick beverage through the day.
I got breathalysed on the way into work the other morning which was a bit scary when he flagged me down;:eek: :eek: I'd had enough whisky the night before to keep tight_jock going for a couple of hours.:beer: :rotfl:0 -
I'm stuck in the office until 5:30 too; have only had ONE phonecall today and that was from me mum.....................:mad:
HSBC were very unhelpful when I started having problems. I could not pay my monthly loan repayment, overdraft and credit card bill and all they could do was offer me a bigger loan. They would not increase my overdraft by £100 but were pefrectly happy to issue me with a credit card that had a £4,000 limit!
Anyway, I think I will just wait and see what they will do. If they harrass me non-stop I will probably declare myself bankrupt (if they don't get there first) and start again with a clean slate. If they don't do anything I presume the debt I have with them will be on my credit report forever!
I got a credit card statement from them last month showing a nil balance; why is this? I didn't pay it and no-one else did!0
