Amazon Marketplace - defective item

I bought a fitness tracker from a marketplace seller. It was described:
"Condition: Used - Very Good - Item will come in original packaging. Packaging will be damaged. Missing battery charger."

The item was clearly defective, as it doesn't hold charge in the battery. There's no communication from the seller, but Amazon will allow me to return the item at my own expense.  Are there any precautions I should take, as I have no trust in the seller?

    If this is a UK item, ie you and the seller are in the UK you shouldn't be paying for the return.
    Get on to "Live Chat" on Amazon and tell them the item is faulty and you don't want to be paying for the return. They'll then give you tracked postage, you may even get a refund without return. You should not be paying for your own return postage.

    Update: I have spoken to CS, and they are giving the seller 48 hours to sort this out. 
    No reliance should be placed on the above! Absolutely none, do you hear?
