Erudio and child tax payments

Hello there

Erudio say that I cannot defer my loan because I am over the monthly threshold. This i because they are combining my monthly salary with my child tax credit payments.

Is this legal?

I know it's not fair.

Any advice would be appreciated.

    Many benefits count as income for the purposes of mortgage style student loan. Tax credits, UC, child benefit etc.  
    Whilst it might not have been descriptive in exact benefits,(UC and Tax Credits weren't even a thing back then) the terms and conditions you agreed to when taking out the student loan laid out clearly that only disability related benefits would not count as income with regard to repayment thresholds.

    So yes, it is legal, fairness is not relevant.
