County Court Business Centre of Fraud

I and my father have been sent a Judgement for Claimant (in default) from CCBC. We were both never sent any particulars of a claim and have never been given any opportunity to defend ourselves. Nobody picks up the phone at CCBC they do not hear any cases and yet they are registered with government and can create online money claims via justice.gov.uk/courts/procedure-rules/civil/rules/part07/pd_part07e for debt agencies.

Had to call the bailiff at my local county court in Teeside whom gave me information regarding the particulars via his access to the debt database. It appears that even after paying for parking a private company can sell on a fake debt or pcn to another debt agency and its lawful for them to create a CCJ from nothing. Me and my father have done nothing wrong but we have to reopen a case they began and closed. £275 each to fight a debt which never a debt in the first place. CCBC might as well be a rogue county court claims administrator.

Somebody please help?

    Your frustration is aimed at the wrong party. The CCBC is just a part of HMCTS and administer initial county court claims.

    Why do you think you didn't receive any claim form of anything from the PPC? Did you update your V5C when you last changed address? That is where PPCs get their RK details from using KADOE rules.

    Which PPC? How come you both received a CCJ? Were there 2 separate claims? As the clam was never served correctly, you can ask for the £275 fee to be refunded when you apply to have the CCJs set aside.

    Read the Newbies/FAQ thread for more information on how to set aside a CCJ. You will be granted a set aside under CPR 13.2 and you can also ask for set aside under CPR 13.3.

    No - they don't sell on debts.  That doesn't happen.  Not allowed. But they do get third party greedy eejits on the case.

    You need to avoid calling the CCBC a 'fraud.'

    What do you need to know from us that's not already in the NEWBIES thread section all about setting aside a CCJ?  There's a whole load of info about completing the N244 in the sticky thread.

    We also do these N244 almost every day here so read a few threads. Here's one from last night:

    If the parking firm used an old address for the claim then you can almost certainly get the £275 court fee ordered against them. Their fault.

    YOU MUST FIND OUT IF THE CLAIM WENT TO AN OLD ADDRESS OR NOT.

    If not sent to an old address, was the claim dated December (loads of claims went astray then, just before Xmas, but the CCBC refuse to admit it).

  • I think my father might have told the parking management company he would be out of the country in 23 May and he is still out of the country living with his grand kids and my sisters family until later in the year. They only administer fraud from everything that I have read.

    According to the advice from the Bailiff at Teeside it is for parking fines from Hartlepool Marina. If this was a genuine claim why did it not come from Teeside Combined County Court which serves the area. Why do all these debt agencies choose to go through CCBC?

    We are not the only ones to have paid for parking and still been sent pcns. Hartlepool doesn't want them. The local businesses don't want Northwest Parking Ltd there and the council too has tried to buy the land back. I bet they didn't even have any intention of opening a claim in the proper way. The cynic in me thinks CCBC sent the particulars of the claim nowhere and just ran down the time to service the Judgement for Claimant (in default). They only administer fraud from everything that I have read. If they sent the particulars of the claim we should have had 5 days from servicing of that and 28 days to defend it. If we'd received them on 23 May we should have had till 23 June? But we received nothing then. If the Judgement for Claimants (in default) arrived then they have our correct address.

    I think you are mistaken to think that the County Court Business Centre are acting in the manner you describe.
    Yes, like all of us they make mistakes from time to time.

    I see that you have overlooked @B789's questions.

    Did you read the linked thread?  You had 19 days to defend and you didn't.  Hence the CCJ.

    Please post again tomorrow when you have all the answers to all the questions I told that poster to ask the CCBC. 

    CCBC are not involved in fraud.

    All small claims either start in Salford or Northampton.  It's how the system works.

    Did your Dad tell the Claimant in writing that he would be abroad for a month?
