Invalid discount code, no formal T&C

At this stage I won't name, names.
A popular sports retailer has an offer on at the moment to obtain a 10% discount off your first app order..
I've gone and tried to order and the discount code keeps flagging as invalid.
I've emailed the company to ask if their is an issue and they have come back to me saying exclusions apply.
The website doesn't quote any exclusions or terms and conditions on its advertising. But in the app it does say excluding sale items.
I've read through the websites terms and conditions (found after trawling through its site) and it has a dedicated area for promotions.. but the link comes up as 404 website not found.
Even the app doesn't have any links to any formal terms and conditions or promotion terms.
I've taken screenshots and sent them to the company to question it's validity, but from a consumer rights, where do I stand on this?

As a consumer nowhere at all.
They don't have to give you any discount

from a consumer rights point of view a price is not a binding contract nor is a discount it is a oinvitation to treat
this means that only when you have purchased and item and the seller agrees that price a contract is formed
you therefore have no consumer rights in this scenario0 -
Worth a complaint to the ASA if you feel their advertising was misleading.

If you can grab a screenshot of the ad prompting you to download the app for the code you can add it to the complaint and the ASA will decide whether the ad breached the CAP code.
That doesn't really help you directly but if it is misleading or such at least they won't be able to run the advert any longer in it's current form.
