    a District Judge has considered the matter and has directed that the forthcoming hearing stated above be vacated owing to lack of Judicial resources and the matter will be relisted accordingly.

    Does this mean hearing postponed and I will get a new date ?

    Pushes your hearing past the DLUHC's announcement and draft Impact Assessment this month!

    Things are changing quickly this Summer and as you are now so close to the DLUHC's Announcement keep hanging around here mid/end of July...see what comes of it.

    Your timing is perfect if the DLUHC in their Draft Impact Assessment (due in a couple of weeks) give us all some damning words to add.

    You could use it at your hearing if there's some useful quotes.  You will probably have time to do a Supplementary WS drawing the court's attention to the juicy bits, if the Government denounce the added fake fees as 'extortion' again.

    Maybe even append UKPC v Masterson at the same time...

    After reading WS may be District Judge put on hold for hearing possibly  DLUHC's announcement - to make their life easy.

    Flipping heck!  By that time the new law will have started in 2024 ... brilliant! Gladstones will hate that.

    I am now preparing my defence.

    Car was parked on same road but with parking permit still UKCPM issued the invoice. Initially appealed the Invoice but they have not rejected but asked for more information. After that I received another 6 more invoices for different dates, all appealed with the same argument and allowed.

    Hi I am a member of staff at  Atlip center Alperton Wembley HA0.My car was registered since 03/11/2020 on your permit portal. Please see attached images.I received a PCN from your side stating Vehicle not registered so I checked the permit system again and I can see that my vehicle was registered on permit portal. Please see the screenshot below taken yesterday. It seems to me an error. I have appealed the pcn on 03/12/2021 but after that never heard back from you. I will appreciate it please cancel the PCN.

    As a veteran of the forum, I would expect that your first port of call would be the NEWBIE sticky or with your past experience just compile a defence using the template defence and the later defences where the claimant provides sparse POC.  Show us paragraphs 2 & 3 that you edit and any that you change or add.  We don't need to see the whole template.  IF this issue is significantly different to your previous one, it might be better starting a new thread.

    preparing the defence and update here.
  • below will be my defence -

    1.  The Defendant denies that the Claimant is entitled to relief in the sum claimed, or at all.  It is denied that any conduct by the driver was in breach of any term.  Further, it is denied that this Claimant (understood to have a bare licence as agents) has standing to sue or form contracts in their own name. Liability is denied, whether or not the Claimant is claiming 'keeper liability', which is unclear from the boilerplate text in the Particulars of Claim ('the POC').

     

    The facts known to the Defendant:

     2. It is admitted that the Defendant was the registered keeper of the vehicle, and my husband was the driver at the time PCN issued.

     3. Car was registered to Atlip centre permit portal since 03/11/2020. The driver made an appeal on 03/12/2021 and state that car was registered all the time on their permit portal but never heard back after that.

    Another letter received from UKCPM stating now the demand will be £100 so contact them send a copy of Initial appeal. Email received from UKCPM and apologised for an error and asked for below –
