Mis sold a motorbike

I’ve recently found out through my insurance that a motorbike I purchased from a well know Bike chain is a Cat N and wasn’t advertised as Cat N when I bought it last September ? I have been advised this is illegal what rights do I have as a customer?

    Did anyone do an HPI?

    Have you done a fresh HPI?

    Have you spoken to the dealer?

    It's possible that it was only recorded as Cat N after it was sold to them/you, that the Cat N was mis-recorded and shouldn't apply to that bike, or that they knowingly sold you the bike with a Cat N but I' not sure how likely that is as they'll have done an HPI in advance and not bought it if it was a write off.

    Do you have Home Insurance and if so, do you have Legal Expenses cover? If so, speak to the Legal Helpline providedby your insurer. They will advise you, and might even represent you to the dealer.

    Cat N is non structural damage, so depending when it was in an accident, the HPI may have come up clear when it was purchased. I'm assuming the dealer would have done an HPI when they acquired it?!?!

    Given some motorbike parts are expensive to replace, then it's quite easy to get a bike written off under Cat N as although mechanically sound, it is not financially viable to fix it. 

    How come the insurance are flagging this up now?

    You'll need to go back to the dealer and let them know. Don't forget you've had 9 months of use of this bike, so don't go asking for a full refund!

    No mention of the age or value of the bike, however even a relatively minor incident which needed a few parts could result in a write off due to ratio of cost to repair v bike value.
