new 2nd PCN claim filed against me even though 1st PCN claim court date is in 2 months

  • Thank you again for your help.

So I sent in an email to Gladstone as per the above.  They ignored me.  I have now received a Notice of Proposed Allocation to the Small Claims Track for this 2nd claim.

I still have not received any paperwork from the court noting that I successfully defended my claim in full and have still not received my costs despite me asking Gladstone for it.

What should I do?  Send in my directions questionnaire?  Try and call the court to complain?

    Thank you all.

    In response to the questions:
    1. I was awarded with costs for lost of earnings, transport and post.
    2. As it was a residential case (parking in a spot owned), it was dismissed as there was no restriction on my use of my allocated car park spot.

The case was heard on 14 Aug 2023.  Can I expect to get anything from the court ordering the Claimant to pay me?  Summarizing the decision or saying that I have won?  Should I wait for that before emailing Gladstones?

Just repeating the above, so people know where you are at.  Yes you will get a brief Judgment in the post this month.

  • Thank you.  So, I assume I should just complete the N180 directions questionnaire and then raise the fact that I have already successfully defended a substantially similar case when I get assigned to the same court?  I would then have the benefit of showing my previous judgment when that arrives.
