P45 advice needed

Hi guys, I need some advice please.

My wife finished with her prev employer in Dec '22 then started with the new one in Jan '23.

Due to unforeseen circumstances the p45 wasn't given to the new employer until this week some 4mths after she started. They won't take it and asked her to fill out a starter checklist, once received they then told her that they couldn't accept it as shes been working for the company for months and that she is to contact HMRC to get a new tax code.  Is this right? Shes been paying BR tax since Jan so could really do with getting it sorted. Thank you in advance. D#

    No idea why she completed a new starter form after working there for 5-6 months!

    All she needs to do is phone HMRC, explain this (not so) new job is now her only job and they will be able to issue the correct tax code.  It will probably be 1257L, the emergency code, on a cumulative basis.

    The employer will recalculate her tax for the current tax year the first time they use the new code and any overpaid tax for the current tax year will be repaid via her wages.

    HMRC will be responsible for repaying any overpaid tax in 2022-23.  This will happen automatically in the next few months.

    She could have avoided this by completing a new starter declaration when she started the new job.  She would have then been on code 1257L, albeit on a non cumulative basis, rather than BR.
