Refund with discount

Hi,

I made an order online that came to £135, and then applied an advertised £20 discount if you spend over £100. 

Once I received the order I realised I wanted to return an item for £27.50. 

When I got the return they only returned £23.42 (taking off £4.08 for discount) 

Now I feel I shouldn't have to have any of my refund taken off for the discount, as should I not have had my refunded item (£27.50) my order would've still come to over £100, but they are claiming that they take the discount off individual items, I feel this is an unfair way to issue the discount and it negatively impacts my refund.

£135 order total
£27.50 refunded item
Total £107.50 (still over £100 so would've been entitled to the discount if I hadn't have had the refunded item) 

Do I have any rights on this?

Yes, if it's still less than 14 days since you received the order, return the whole lot for a full refund, and re-order (if they'll let you re-order).

Without knowing the terms of the discount, I couldn't say if it's unfair.  What you feel about it is irrelevant, it's the terms that matter. If the terms are that the discount is applied across individual items, then what they've done is entirely fair.  Lidl for example apply their £2 or £10 discounts across all of the items.  If the terms say the discount is not applied across all items, then they haven't applied it fairly.

Where did you purchase from? 

We do offers like this and it’s clearly stated in the terms that the discount is apportioned over the entire order and any refund you receive will reflect this. It’s pretty commonplace.

I've checked the T&C's  and it says nothing about how they will spread the discount across the items. (they go into refunds with multibuys etc) it's been passed on to another department to look into. I'm happy to relent if it is part of the T&C's but currently (unless I have missed it) it doesn't state anything along those lines.

This is all I've seen on their T&C's regarding discounts on orders.
The £20 off £100 is still running so clicked on the T&C's couldn't see anything else only this about multibuys.

I think its fair if it's a consistence rule by I'm surprised they do it

Say a person returned a £40 item on a £135 order. Under the rule they are using a person  would get a £34.08 refund.
Under the other way of working it out then the refund would be £20

I think this is a fairly typical way to do it. I'm sure you'd be more upset if the item was £36 in value and they said they'd only refund £16

I'm not sure it's that typical.

Buy a few items that total £100.01  get £20 off  so a 19.99% discount.
Return £90 of items  but  still get the 19.99% discount on the £10.01 item that was kept.

Yep I think that is generally how it works. At least once you get to large scale refunds done by computers not people type operations. 

Similarly with spend x to get free postage offers, if you return stuff generally you won't be charged for the postage you would have paid. That's one people regularly exploit.
