Hi I’m new here I hope you can advise me please.
We have been on a DMP plan since 2011 (yes that long)! We owed about £60k and we are down to £6k I am quite proud of us for getting where we are despite the length of time that it’s been we have learnt so much.
My eldest DD is off to uni in September I am a tad worried about costs, I don’t have £6k to pay off the DMP balance.
I want it gone if I’m honest Is there a way around this?
It’s been too long to contest affordability but I have read on here people mentioning CCA and unenforceable debts?? New to me!
I don’t want anything to affect my ability to move house when DD finishes uni, we currently have a mortgage.
Any advice would be appreciate thanks 😊

If they are with debt collectors then you could try making a full and final settlement offer to clear them for a reduced amount.

Making a cca request is a good idea too, I had an old barcltdebt that I've stopped paying as PRA couldn't produce the agreement.

Have they all defaulted and are they still showing on your credit report?

Hi Rob5342 thanks for the reply. So when you stop paying what happens to that debt? Does it go against you in any way? Thanks

just my though DMP plan since 2011, nothing on credit reports so dropped off now. I would try CCA be very surprised if they can provide anything now as suspect credit was taken out before 2011.

I have a Barclay card debt sold to PRA, took out about 2010 so far PRA cannot produce CCA.
I have Dyslexia which is a learning difficulty that primarily affects the skills involved in accurate and fluent word reading and spelling so some post may not make sense.

    Some good suggestions there.

If you have been on a dmp since 2011 i would expect that they were all defaulted around then and dropped off your credit report around 2017.

If they are Consumer Credit Act debts (i.e. not utility debts or mobile phones or overdrafts) then you have the right to make a formal request under s77-79 of that Act. The debt is then unenforceable until they comply so there's no downside

With debts of that age, and particularly if they have been sold to a debt buyer, there is the good chance of a settlement deal. I'd only bother with the enforceable ones.

In fact I'd probably stop paying the dmp now as it sounds like you are paying 4 or 5k a year into it, and immediately start to save a fighting fund. If you are with a provider who charges a fee then I'd definitely stop paying

They can still.ask you to pay it, but there's nothing they can do if you don't, and as it's not on your credit report nobody else will know anything about it. It's possible they could find the agreement later which would mean they could get a ccj against you, but if that happened you could just start paying again.

They word the letters very carefully and push it as far they can to try and make.you think you should pay without actually saying you do have to. They can be persistent so you just have to stick to your guns.and ignore them.

Thanks fatbelly it’s always been with step change. I think I am going to read the CCA link on debt camel and take it from there.
    Thanks everyone.
