    But at least you have a POPLA code. Even if you lose you won't be paying so you may as well do a good POPLA Appeal as shown in links in the 3rd post of the NEWBIES thread.

    What happened to cause the PCN?  Overstay at a retail park or what?  If overstay, was your friend with you that day (their condition meets the definition of disability without a doubt).

    Which exact site, it may have come up here before?

    Are you local enough to get signage photos and LACK OF signage views of the entrance?  You'll need photos for POPLA.

    You have a month to use the Code.  Don't do it in your own words. Run it by us first, using the examples in the NEWBIES sticky 3rd post.
    Can I ask, what do you mean when you say “even if you lose you won’t be paying?” I must say I get quite scared by the letters and my biggest worry is affecting credit score when we are due to remortgage. About the other questions it was overstay in retail park crown point north in denton. Friend was seperate incident but similar time I told her to fight it at least a little but doesn’t have the energy so paid them the full £100 and never even received the chance for £50!

    A PoPLA decision is not binding on the motorist so can be ignored.

    The only way to get a CCJ is if you get court claim, and lose, and fail to pay within the court mandated timescales. 
    Very few of the people we help lose in court as long as they follow the advice and guidance and don't miss any deadlines. This is all within the defendant's control.

    However, you are nowhere near court so nowhere near a CCJ. Credit scores are meaningless. What is important is your ability to obtain credit, but as long as you follow the advice on here, you won't get a CCJ.

    What a shame your friend paid. It could so easily have been won, but these unregulated companies prey on people's fear and bully them. They should still complain to the landowner and their MP. The PCN may well have been a breach of the Equality Act 2010 which is a criminal offence.

    PLan A is still a complain to the landowner and your MP.
    If it isn't cancelled in time, then produce a draft PoPLA appeal and show it to us before you submit it.

    This will normally include

    Not the landowner
    No standing to issue charges in their own name
    BPA CoP failures (if relevant)
    Non PoFA compliant NTK incapable of holding the keeper liable (if relevant)
    Inadequate signage
    Anything else relevant.

    Use the examples linked from the third post of the NEWBIES to create your appeal.

    If this is UKPC (not UKCPM?) you will never get a CCJ and there will never be a court hearing in future, if you follow our advice.  No need to worry.  

    No-one here pays if they lose at POPLA.

    "By law we are also required to inform you that Ombudsman Services provides an alternative dispute resolution service that would be competent to deal with your appeal.  However, we have not chosen to participate in their alternative dispute resolution service.  As such should you wish to appeal then you must do so to POPLA, as explained above.

    Read my reply above and substitute CP Plus for 'UKPC'.  The advice is no different.

    No-one here risks a CCJ because we know how to appeal and/or defend and kill cases off.
