Paypal strikes again

Hi, would any one be able to help and offer me some advice as I have just about had it with paypal.

In July i sold a phone on ebay for £330. I waited over a week for the funds to clear into my bank account before I sent the phone out. After another week I received an email from ebay saying they were deleting the listing as something had gone wrong with the listing, I replied that I had already sent the phone and got the money so they said not to worry about it.

Then Paypal demanded proof that I had sent the phone, which i provided them with. They then emailed me saying that the person who had brought the phone had been using the account fraudulantly and i had to give the money back. I said of course, but i want my phone back then. They said they cant do that and I had to pay the money back.

It has been 5 months now and they have passed the case to Robinson way debt collectors who are calling everyday. I have the address of the person who has got the phone and the royal mail tracking number to say it was posted there.

I really don't no what to do anymore, I dont have money to give them, and I dont see why I should, if i havnt got my phone. It seems like this goes on a lot with paypal, can anyone help me?

    Then look for the UK Financial Ombudsman site, have a good read and contact them if required.

    Paypal soon caved in when I had a chargeback against me and involved the Ombudsman.

    It takes a bit of time but it is worth it!!
    Dont sign any declarations from Paypal with regard to withholding settlement details if the claim is settled by the Ombudsman. They usually send you a disclaimer so you cant tell anyone else about the settlement details.

    As the site above says, it costs THEM £360.00 to have claims against them investigated, so at least you know that they will have some financial pain!!

    I think there is a good case for this to be a sticky as it gives a lot of info which will help a lot of those with incorrect chargebacks from Paypal.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    Assuming you complied with the paypal terms and conditions and the phone was sent to a confirmed address and you have proof of delivery then you have no problems. Just enter the online tracking details into paypal and then insist they stand the loss themselves as per their own rules. If you hadn't already entered the tracking details when you sent the phone they won't know that you have complied with their terms. Incidentally, paypal do not ask for proof of postage, they actually require proof of delivery and there is a sticky on the ebay and other auctions board with a list of the approved methods they allow in their terms and conditions.

    If however you failed to abide by the t and cs and the address was unconfirmed then you will need to chase the person who signed for delivery of the phone (I'm assuming the phone went tracked due to the cost as of course standard post would only cover £34 of loss anyway and couldn't really be used for a phone). Assuming you have proof of delivery you have all the info you need to persue the 'buyer' through small claims, you have their name and address and proof they have the item!

    If you have no proof of delivery then I can't see that you have any real chance of fighting this easily as proof of postage is meaningless really as any court will need to be assured that the 'buyer' has the item in dispute.

    I like paypal and use it all the time for my ebay sales but would always strongly urge people to read and understand how it works rather then just to use it without any idea how to protect themselves. There is an impression bandied around by ebay mainly that paypal is completely safe for sellers and yes it is, but only if you understand what you need to do to stay safe.

    Also one other point, to retain seller protection you would have needed to post the phone within 7 days of payment anyway, waiting for payment to reach your bank account gives no more protection and just irritates buyers and leaves you un protected if that should take you over the 7 day limit.

  • You should report this to your local police as the buyer is trying it on and with their help you can get PP off your back.
