Secret_Squirrel said:Apparently, during the fault based divorce laws there is absolutely nothing you can to re-open the case or appeal the case, if you have provable evidence that the divorce grounds were entirely fabricated or the other person used misleading evidence, domestically abused the husband, had embezzled money in the marriage, engaged in credit fraud or failed to contribute. If there's someone reading this who can truly advise otherwise, please say because I've tried everything I can think of severely out of pocket and suicidal.
We don't allow forced marriage in this country and the courts are not going to force an ex to remarry someone even if (big if) it can be proven the grounds for the divorce were fabricated. In theory they might get in trouble for perjury. In practice I would be surprised if the CPS considered it in the public interest given that no-fault divorce is now legal.
Divorce settlements are based on meeting the needs of each partner and any children and splitting the marital assets equitably, not on fault.1 -
Oh no. This doesn't sound good.
Was your divorce application ever issued??
You cannot apply for a financial remedy in the divorce until you've got a conditional order in the divorce. You need a consent order and a d81 (statement of financial information from) to to be submitted to the court0
