Ebay management of mis-selling of an item

    As per Soolin’s suggestion - if the item was described as being Silk by the seller themselves, then the item can be returned via a SNAD claim. 
    If it was not described as silk by the seller, and was just in the eBay category as such, then that changes things. 
    Hence Soolin’s question is perfectly valid.
    It sounds like buyer has already had their money back anyway.

    Edit: I understand the specifics of what happened are important for how a case should have proceeded, but in the OP it says:
    I requested a return through Ebay and they accepted that I was entitled to a full refund but..
    They said that the seller hadn't done anything wrong and that is how they were categorising this dispute.  

    Which to me implies they've returned it, had a refund, and can move on with their life.

    I wasn’t sure, but yes I see what you mean. In that case OP if  you have your refund what exactly are you looking to go to court over? 

    If you believe eBay are maliciously and intentionally allowing breaches of the law by sellers this could end up a multi million pound law suit , this wouldn’t be a quick half hour in a local magistrates court. You might also want to include every other site in your action as well, I’ve had stuff from sellers on Amazon completely mis described (something glass that turned out to be a clear resin was one thing I can think of). Also Etsy ‘vintage’ items brand new out of China, Facebook marketplace needs closing down all together as stuff is rarely as advertised, Vinted is shocking- the list goes on and on. 

    Yes things ought to be exacty as listed, but there is a remedy if it isn’t , and on eBay that is a return for a full refund. However you didn’t even confirm that item was clearly stated as silk in item description or whether it was merely mis categorised.
