Thank you both. I have made those adjustments.

My mother has asked me to ask a question prior to sending this Defence off. Does it matter if the sign in the car park said that people holding a blue badge should display it or, does that not matter? We ask as the template defence talks about vague/hidden terms but if it was on the sign, is it still acceptable to include this?

    Thank you.

    Yes you must include it.

    Question for you:

Where on the Blue Badge signs (specifically this signs directly at those bays, the only ones that can be read from a driver's seat) does it mention a contract and agreeing to pay £100?
    Doesn't, does it...

Thank you @Fruitcake for your knowledge and input.

And thank you @Coupon-mad for that!

I will not touch the template defence and will submit it this afternoon as written.

I will of course keep you all updated. Hopefully we can beat these people again!

    No worries @jinxy2301

We are also fighting the entire war, not just single battles.  Did you know that the law is finally about to change?

I'm on the Government's Private Parking Code of Practice Steering Group and whilst I can't talk about the work, this rogue industry will be regulated within months.

I am telling you this in case you missed us talking about the upcoming Public Consultation on the level of parking charges.

Hopefully open for responses in August for 12 weeks, and it is the final step.

Please read that thread and bookmark it - and set email alerts on your profile - so you get a notification when the Public Consultation opens.

We need you and your wider circle of family/friends to respond!

Motorists need the new law over the line and whilst the new Code has got most things right, it still allows a huge £100 for minor mistakes by valid users of residential car parks and Airport roads which IMHO is unnecessary extortion in most cases.

And £130 in London is an ENORMOUS INCREASE on the current cap - completely unjustified.

Not to mention the added fake £70 'fee' that takes cases to bulk litigation and MUST be banned outright.

I hope you will come back in August and join us for the final push?

    Hi everyone,

Just had a really confusing and worrying email from DCBL in response to my e-mail in this thread asking for it to be cancelled.

    It says:-

    "Dear XXXX,

DCBL are no longer instructed upon the DCBL reference XXXX.

DCBL note you have provided the CCJ claim reference number XXXX. DCBL are not instructed upon this matter at this time. Please check the details on the correspondence you have received and respond to the relevant company accordingly."

I have just looked at the claim form again and it was definitely dated 19 May 2023, AOS filed on 31 May 2023 and Defence filed (with automated response received) on 16 June 2023. I have looked at the address for sending documents to on the claim form and it clearly has DCBL details. I am so confused as to their response and, why they have mentioned a CCJ.

Please can someone tell me if I should respond or what I should do?

Just to add I have logged into the MCOL and the latest says the defence was received on 16 June 2023.

    Thank you

You can safely ignore that. They don't know what they are doing.

Their mention of a CCJ is clearly due to their lack of understanding of the court processes and nomenclature - nothing more.

You have correctly filed a Defence so keep your eye on that checklist you were following when you did that.

That's presumably because you emailed DCB Ltd?  Wrong company.

They are (slightly) different from DCB Legal who ARE instructed in the claim.  Re-send it to DCBLegal.

    Thank you.

The correspondence received has all been from DCBL. My mother does not recall receiving a letter from DCB Legal but I have found an email address for them and will email them with the same email.

I am slightly worried now as in the defence we had written that we made them aware of the disabled status prior to filing the defence but obviously made a genuine error in thinking DCBL and DCB Legal Ltd were the same people. If it comes up in future I guess I will just have to say that it was a genuine error and emails were sent to DCBL prior to filing the defence. Hopefully it will be discontinued before then.

I may say in my email to DCB Legal that we made their client aware via email to DCBL on [date] June 2023 as set out in the defence but have now been made aware today they are no longer instructed hence we are sending it to them instead. Does that sounds ok?

It's all fine.  No need to add anything to the email, just re-send it.

They are the same group, so you've done nothing wrong and don't have to explain yourself.
