Help with car insurance

Teenage dd was involved in a car accident when a car went through a give way sign and hit her side on. We're now 5 weeks on and have no idea whether her car can be repaired or is a write off. She had her own insurance through ticker (broker) but when we contact them, we are told that because the 3rd party wont admit liability we are at stalemate and they wont assess her car until this is sorted out. Surely this is for the insurance company to sort out ? Going round in circles. She'd ordered a new car the week before her accident and is due to get her new car in 2 weeks. Her car was being used as the deposit for the new car.  Anyone able to offer advice.

    Assuming that it's comprehensive insurance, I think she needs to raise a formal complaint.

    Photos? Side-on impact on a road where she has priority sounds about as clear-cut as it could be. Did they admit liability at the scene and then rescind it?

    Ticker are an intermediary rather than a broker, their new driver policy is exclusively underwritten by an insurer based out in Malta. I also note that the email address they give for claims is Carpenters Solicitors (a search on here will give some other members experience of this firm).

    By the sounds of it they are trying to establish liability so they can then pass the details onto a credit hire company to deal with the matters for you and get a higher commission rate from them for having validate liability/indemnity before passing the details over.

    Your two options really are:

    1) Put in a complaint following the process in the policybook stating that you have comprehensive cover and so want to proceed with the claim under the terms of your policy

    2) Find out who the third party insurer is, if you dont know already, and claim directly from them and cut out your insurer entirely.
