UKPC/DCBL County court business center claim - customer leaving site

KeithP said:The CCBC sent you a letter, or will send you a letter, saying the Claimant has twenty eight days to consider your Defence.
What you don't know is when the CCBC sent a copy of your Defence to the Claimant. It follows from that that it is not known when the Claimant has to respond to the CCBC.
Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like.
And this recent thread indicates that longer delays are likely... CCBC are currently 26 days behind with DQs
Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back at the CCBC, remembering to send a copy to the Claimant of course?

How come the defence didnt work?It was never going to work just like that, as if a magic wand was being waved. Keep going through the processes to get ever closer to a discontinuation. Resilience and patience! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I think I'm just eager to get rid of the whole situation, and a little worried that they may go all the way to court and my partner, as much as I love him, isn't the sharpest tool in the box at times (hence being in this situation in the first place, bless him).
So im just sitting and waiting and hoping eventually they still decide to discontinue?!
I can see how they try to instill fear into the general public and how most people end up caving.
Thank you all again1 -

Thank you all againThe letter you have is so standard that it's already listed in the Template Defence first 12 steps.
Do you know what the next step is after this, and that defence is not your only job? Re-read those first 12 steps and please don't ask us about the N180 form in August.
But we do have one favour to ask, for August, please:
We need you - as a genuine PPC victim of aggression, sharp practice and an 'extortion' attempt to add £70 - to respond robustly to the Public Consultation on the level of parking charges and banning of the false added DRA 'fee' that too many honest motorists currently fall victim to.
It will need consumer input (powerful voices) but change is afoot. It's taken about 5 years to get to this stage:
https://forums.moneysavingexpert.com/discussion/6333036/breaking-news-government-has-announced-the-statutory-code-of-practice-and-enforcement-framework/p1
And then the industry threw victims' money at it and blocked and delayed it - explained here:
https://forums.moneysavingexpert.com/discussion/comment/79310609/#Comment_79310609
Please now Bookmark BOTH threads and set up email alerts on your posting profile, so that you get an email alert when we post there, as we will, once the Public Consultation opens...
...anticipated THIS MONTH...!
We need people like you and your driving family & friends to respond in high numbers! You have a personal story to tell about the culture of getting a roboclaim 'legal' firm to add a pointless £70 for their own profit, to be let loose to intimidate people.
I am sure you want your voice heard to stop this happening again. See you in August to get the new law across the line.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So, we are at the stage where, after going through the process my partner has now received a 'Notice of Transfer of Proceedings'. Now i know reading through the posts there is still time for DCBL to cease proceedings, but i know the 'witness statement' part will be coming up.
Ive trawled through the forum looking for other peoples drafts, and wonder how detailed this section needs to be. Are there any drafts for 'driver leaving site' claims or a template of any kind??0 -
Detailed story and reasons why the D is not liable, with exhibits. Recent good examples are by:

Hi, its been a while, my partner has been given a court hearing date, however the letter with the date has been lost. We know it is in June and my partner thinks it is the first week in June.
Also i dont remember seeing anything on the letter about a witness statement so i now fear the date has been missed to send in a witness statement.
We are currently looking for it. If the date has passed for the witness statement what is the next option??
Thanks0 -

Done that and we now know it is 6th June, next thursday.
What do i do about the witness statement? can i still send it across or it says in the letter if you are unable to attend to let them know at least 7 days before. Could it be postponed?0
