Scaffolding over my back wall using private road

Have you ever heard of anyone, anywhere, being fined for "trespassing"?housebuyer7 said:I guess I may be fined for trespassing?!4 -

Trespass is a civil offence (in most circumstances), so you will not get fined. The worst that will happen is a few choice words from the land owner and perhaps a request from a police officer to "move along".
Any language construct that forces such insanity in this case should be abandoned without regrets. –

Treasure the moments that you have. Savour them for as long as you can for they will never come back again.1 -
I live on a private road. There are some strong signs at the front of the road signifying that you can't enter, turn round or park in the road.Realistically, it's poppycock. 4 of the houses on the main road we branch from have no access officially to the road, but they have all adapted their back gardens to park. Another on the other side parks his motorhome on the road and has modified his side gate to encompass a garage in his back garden.People get funny about these things, but unless they can prove you are doing something to damage their property, there's nothing they can do. The Police would laugh at them. Especially as you're trying to get access to your own property. What I would suggest, however, is that you notify them. Do it in a strong way - say "We WILL be doing this and that to access my property, however, we will also be keeping this to a minimum"Make it clear to the scaffolding company that they need to move their vehicle as soon as possible. I'd probably make sure that you're about too, in case one of the owners comes out remonstrating.0

We have just moved out of a property that was on a private road and I'll tell you, nobody took any notice of the 'Private Road' signs and continued up the road anyway. At the start I used to find it funny that people would come up the road and then reaslise they couldn't get past the locked gate next to our house and had to use our driveway to turn around...got very frustrating in the end though and was one of the reasons we ended up moving.
Anyway, back to the query, I would do as Divorcing_Dad suggests and just inform the houses on that road that you need to get scaffolding to the back of your house, and having looked at the possibility of getting the scaffolding through the house, your only viable option is to have it passed over the rear wall from the road and it will be happening on x date.
Perhaps add that you appreciate it is not ideal but you will make sure the scaffolders are as quick as possible to minimise any inconvenience to them.0 -
Firstly, I would find out from the scaffolders how long it will take to put up and take down the scaffolding and approx dates.
Next I would put notes through each of the houses explaining the situation and asking if you could use the access road for X hours (probably not more than an hour) on X dates. Ask for replies by email, preferably or note back. Say that you understand this is private access and ask if there is a management fund, into which you would be willing to make a contribution for upkeep. But don't take the pee and start having deliveries that way.

That's just an uncalled for nasty approach - "I'll do whatever I want with your private land because you can't do anything about it".
I thought that in general we were more civilized than that1 -
Here’s the road below - my wall is behind the hedge. I’m afraid I’m not sure yet re the size of poles but whatever is standard for the rear of a two story property (ground floor, first floor, roof). There is a passage way three doors down from my house so I wonder if they would need to park, they may be able to pass things across via hand bringing round on foot. However I believe the residents also have an issue with this (just the act of passing things over).

I have been in your neighbour's position - not a private road, but workmen wanting to cross my garden for their own convenience, rather than it being the only option. I say yes, because I value relationships with my neighbours, but usually need to grumph inside as more often than not they are careless eg crushing plants with footprints where they had no need to be, banging the ends of poles against things...
But a banker, engaged at enormous expense,Had the whole of their cash in his care.

Resolving problems such as this is most successful if those involved have a fair sense of balance, and I sincerely hope those who have to use that Portaloo possess one!
