TalkTalk - Early Exit Fee for deceased person.

Just sold my late mother's house and cancelled the broadband (retained so that securty system still active).
I (as excutor) took over ownership of the line in July last year.
On exchange I phoned to cancel and have been told that there is a compulsary 30 days notice an there is a £37.89 early exit fee on the contract, which according to the My TT web site runs until Oct 23.
They would not budge on waiving this fee.
Also as the Completion was the day after exchange I have no idea wether the new owner will be able to commision broadband for themselves until the line is released on 14 June.
