Credit agreement for services to a business

Hi, I am being chased for payement from a company who failed to provide the services they agreed, we have notified them during the cooling off period.

They are chasing constantly, I would also like to mention the credit agreement wasnt signed by a Director of the business, does this make the agreement non-enforeable?

    Why does the cooling-off period come into play if they've failed to provide the service?

    This sounds like it might be a B2B contract? Just from the way you've written it.

    Re-reading this, especially the title, this must be a B2B contract.  That means that it's down to the contract to determine what's enforceable and what your rights are, rather than consumer law.

    Contracts dont have to be signed to be enforceable, just as they dont have to be written. From what you say the agreement was signed and so it's a bit of a moot point. There can be issues with unauthorised members of staff signing for things but you dont have to be a statutory director to have authority. Most companies will give relatively low managers the ability to sign things like NDAs or contracts up to certain values and it's just higher value ones that may need to go higher.

    It's unclear if you are mistaking consumer cooling off periods as being relevant or if you are taking about a cooling off period in the contract. Similarly if they provided no service at all or they provided something but not exactly what you were hoping for.
