Car clamped outside garage - what can I do?

Hi
Im after some advice please? My car was towed to the garage I use for repairs, it wasn’t taxed. The repairs were done and the car was left beside the garage. I planned to tax it before collecting it but that took longer than I planned as I’m a carer for a disabled mother of two children and the mother was really unwell so I never got a chance to tax and collect the car (too many stressful things happening) my 14 yr old was raped so the car and taxing it went right out the window. I planned to collect the car tomorrow (tax it beforehand) but it’s now been clamped and I have 24 hours to tax it and pay £100 (I don’t have spare money) or it goes to the pound. Im wondering due to extenuating circumstances and the fact the car wasn’t driven, it’s insured and MOT’d. Can I appeal this charge? If so who do I contact?

There is no statutory right of appeal or right of review once a car is clamped if you do not pay a release fee. The law says that a person can dispute the release fee once it has been paid. The person can appeal to the DVLA and then to the magistrates' court within the appropriate timescale if the appeal is refused.
The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.1 -
Who has clamped your car? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

It was dvla leaflet ref INF32
the website is
www.cartaxenforcement.co.uk but there’s nothing about appealing the decision. I’m in Aberdeen and I have 24 hrs to pay the tax and the fine or it will be taken to the pound in Edinburgh. The car was not used while it had no tax, as I say it was towed to the garage for repair and I’ve been late to tex and collect it due to all that’s going on in my life. I’ve never driven a car with no tax, I wouldn’t. I don’t know what to do.1 -
We deal with private parking charges. I suggest you seek advice from our friends over on PePiPoo who deal with these kind of situations much more often than we do. Register there, but please note a hotmail email address doesn't work - use a different one. Please note, we are not a legal advice forum.
