SEAT Challenge Promotion on Heart Network, May 2023 Specific Rules 

1.     The SEAT Challenge promotion (‘Promotion’) is organised by Global (as defined in the General Terms and Conditions). The Promotion will run from Tuesday 23rd May to Tuesday 30th May 2023. Global is the Promoter. The ‘Promotion Partner’ mentioned in these Specific Rules is SEAT and the ‘Prize Provider’ is NDL. 

2.     IMPORTANT: The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here (together, the ‘Promotion Terms and Conditions’). Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions. 

Details of the Promotion: 

3.     To enter the Promotion you must:  

a.     (i) go online to the Promotion entry page at heart.co.uk/win and register your details;  

b.     (ii) upload a 30 second video of yourself (your ‘Submission’) explaining why you’re up for taking on an in-studio challenge with Heart Breakfast and why you love adventure – perhaps you’re the first in your group of friends to take the stage for karaoke, or the prankster amongst your colleagues willing to prank call the boss!  

4.     Your Submission must be in .mp4 or .mov digital format with a maximum file size of 500 MB and be no longer than 30 seconds in duration. A Submission with a larger file size or which is longer in duration than this will be removed from the Promotion.   

5.     All entries will be judged by a panel of judges including one independent judge on the following criteria; 

                        I.how unique the Submission is;  

                       II.how well the entrant's sense of adventure is reflected in the Submission;  

                     III.how entertaining the Submission is and;  

                     IV.how family orientated the Submission is.  

6.     Five entrants will be selected to complete an in-studio challenge as described in point 12. The judging panel will rank these 5 entrants, 1 to 5 based on how closely they fit the criteria with 1 being the entrant the most fitting and 5 being the least. 

7.     Entries deemed by us to be rude, offensive, defamatory, illegal or condoning dangerous behaviour will be removed from the Promotion. 

8.     Online entry will open at 17:00 on Tuesday 23rd May 2023 and close at 23:59 on Tuesday 30th May 2023. Entries received before or after this time will not be included in the Promotion. 

9.     The judging process will take place on Wednesday 31st May 2023. 

10.  Selected entrants will be contacted by one of our representatives via the telephone number with which they registered to enter the Promotion. Global will attempt to contact the entrant three times; if we are unable to get hold of the entrant they will forfeit their right to participate in the Promotion and we shall be entitled to select another winner from the original list of entries.  

11.  The selected entrants will be asked to come to the Heart Studios in London at 30 Leicester Square, London WC2H 7LA. The date and time on which they will need to come into the studio will be based on the order the judges ranked them via the process described in point 6. 
I.         Rank 1 – Monday 5th June 2023 between 06:30am-08:00am 
II.         Rank 2 – Monday 5th June 2023 between 09:00am-11:00am 
III.         Rank 3 – Tuesday 6th June 2023 between 09:00am-11:00am 
IV.         Rank 4 – Wednesday 7th June 2023 between 09:00am-11:00am 
V.         Rank 5 – Thursday 8th June 2023 between 09:00am-11:00am 

12.  When at the Heart studios the presenters will only then reveal the mystery challenge. The presenter will describe the challenge on air along with any rules and time restrictions, example challenges could include – identify songs that are being hummed by a presenter or answering a series of questions whilst facing distractions. The entrant will have the opportunity to ask the producer questions about the challenge before they participate. If the entrant completes the challenge, they will be announced as a winner and awarded the prize. If they fail the challenge or do not participate the entrant will forfeit their right to the prize. The producers/presenters’ decision is final as to whether an entrant has successfully completed the challenge and no further discussion will be entered into on this matter. 

13.  If an entrant is unable to visit the Heart studios at their given date, they will forfeit their place in the Promotion and a new entrant will be selected in their place.  

14.  By submitting your entry to this Promotion, you confirm that you have obtained the consent of any individuals that may feature in your Submission (in the case of children under the age of 18, you have obtained the consent of the child’s parent/guardian) and agree to notify us immediately if their consent is withdrawn at any time. 

15.  We and our Promotion Partner may publish and publicise your and we may refer to your association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion. 

16.  In relation to winners (and runners up if applicable), you understand that we and our Promotion Partner may: (i) interview you and your guest(s)/travel companion(s) which we may film, photograph and/or record and; (ii) film, photograph and/or record, you and your guest(s)/travel companion(s) in connection with the Promotion, either by telephone or in person, and we may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as we consider appropriate or desirable, in connection with the Promotion. We may also publish your and your guest(s)/travel companion(s) name, image, social media handle and/or profile picture. 

Eligibility: 

17.  The Promotion is only open to residents of the UK aged 18 and over, and who are based in the UK at the time of entry. 

18.  Entry is restricted to one entry per person; duplicate entries will be excluded from the Promotion. 

19.  Entrants must be available to attend the Heart Studio at 30 Leicester Square, London WC2H 7LA at the times listed in point 11. Travel to and from Leicester Square and the Finalist’s address and overnight accommodation will be provided for the night before the date they are required.  

Prize:  

20.  One winning entrant per day (a maximum of 5 in total across the Promotion) will receive a trip to Barcelona, please see prize details below: 

                        I.Return flights for two adults and two children to Barcelona, Spain (Children must be aged 11 and under). 

                       II.Return transfers from the airport to the hotel 

                     III.3 Nights’ accommodation at a 4-star hotel in Barcelona 

                     IV.Breakfast for two adults and two children in the hotel restaurant each morning

21.  Travel is subject to availability at the discretion of the Prize Provider and excludes the Christmas holiday period, Valentine’s day/weekend, Easter weekend and all other bank holiday weekends in both the UK and Spain. Must be booked at least 3 months in advance. 

22.  Prize includes return economy flights, all flight taxes and surcharges but doesn’t include any checked in luggage. Subject to availability, departure airport used will be the winners nearest international airport that operates flights to Barcelona. Please note, this may not be your closest airport. Direct flights cannot be guaranteed. If you don’t hold a UK passport you may need a visa for this destination, and this should be arranged with the appropriate embassy. Although please note the cost of a visa of this kind isn’t included in your prize. 

23.  Transfers to the hotel/airport are not private and you may be sharing with other passengers. 

24.  Children must be aged 11 and under. 

25.  Parasailing experience will last up to 1 hour in total with a 10–15-minute parasailing flight and is subject to availability at the time of booking.  Participants should be over 8 years old or over 1m tall.  ID Card or Passport will be required. Go pro service is not included, however the winner can choose to add this at their own expense. 

26.  All prizes must be claimed and booked by the prize winner within 12 months from the date of the Prize Provider’s initial correspondence with them. 

27.  You must, at your own cost, comply with all necessary checks, and/or tests required for travelling to and from and entering and exiting your travel destination/venue. This includes, but is not limited to, purchasing, organising, undertaking, recording and/or registering any required Covid-19 tests. We will not be responsible for any costs incurred by you in complying with this clause, nor will we purchase, organise, undertake, record and/or register any required Covid-19 tests.  

28.  You must comply with all applicable rules, regulations and guidance relating to Covid-19, both in the UK and your travel destination/venue. We are not responsible for your failure to comply with such rules, regulations and guidance.  

29.  You acknowledge and agree that, without limitation to the provisions of Clause 12 of the General Terms & Conditions, our ability to fulfil a prize and/or perform any of our obligations under the Promotion Terms and Conditions could be affected by an actual or threatened epidemic, pandemic, disease or quarantine and/or any corresponding governmental action, guidance and/or ruling (including but not limited to any Foreign, Commonwealth & Development Office guidance) (collectively ‘Covid Measures’).   

If due to any Covid Measures, we are unable to fulfil a prize or perform any of our other obligations under the Promotion Terms and Conditions, then we shall not be in breach of the Promotion Terms and Conditions. In accordance with Clause 33 below, in these circumstances, we reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion. 

30.  Travel insurance will be provided by the Prize Provider and is subject to normal terms of acceptance. Pre-existing medical conditions may not be covered. No age restrictions apply. Should the Prize Provider be unable to purchase travel insurance on the winner’s behalf, a cash fund of £30.00 per person will be allocated for travel insurance and will be provided to the winner via bank transfer. Should this be the case it will be the sole responsibility of the winner to obtain suitable travel insurance for themselves and, where applicable, their guests. 

31.  Any other costs and expenses which are not specifically included in the prize description are excluded and will be the sole responsibility of the winner. By way of example, without limitation, cash is not included within the prize. 

32.  The prize is non-transferable and non-refundable.  

33.  We reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion.

35.  Your personal data that you provide to us will be collected and processed by us, our licensees (including Communicorp UK Limited) and our Promotion Partner as well as the prize providers, and if applicable, our service providers, network operators and suppliers in order to administer and fulfil the Promotion. Your personal data may also be disclosed to the Phone-paid Services Authority, Ofcom and/or the Advertising Standards Authority at their reasonable request for regulatory purposes, for example, in order to prevent, investigate and detect crime, fraud or anti-social behaviour and comply with law enforcement agencies and applicable advertising codes. 

36.  By entering a Promotion, you acknowledge that any personal data provided by you in connection with the Promotion will be processed as set out above and in accordance with our Privacy Policy which sets out full details of how we process personal data and how you can exercise your rights as a data subject, and  our Promotion Partner’s Privacy Policy. Please ensure you have read and understood our Privacy Policy and  our Promotion Partner’s Privacy Policy before entering any Promotion. If you are required to submit a guest(s)/travel companion(s) personal data to enter a Promotion, you must ensure that your guest(s)/travel companion(s) have given you consent to provide us and our Promotion Partner with their personal data. 

37.  You may be asked if you want to opt-in to marketing from us and our Promotion Partner when you enter a Promotion. If you choose to opt-in, we and our Promotion Partner will use your personal data for marketing purposes (see Global's  Privacy Policy and our Promotion Partner’s Privacy Policy for more details). You can withdraw your consent to marketing at any time by unsubscribing.  

38.  We, our Promotion Partner and the prize providers may transfer and process personal data outside of the EEA and UK for the purposes of administering the Promotion. Where any transfers are made outside of the EEA or UK we and our Promotion Partner will ensure appropriate safeguards to protect your personal data are in place.  

39.  We will hold your personal data for a period of up to 3 years in order to comply with our regulatory obligations.  

40.  You may request the removal of your personal details from our database by contacting privacy@global.com. If you request that your personal details be removed prior to the conclusion of a Promotion, you will forfeit your right to enter the Promotion and/or claim any prize and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable.
