Discovered a CCJ on Credit Report. Incorrect Address.

Seeking assistance from this incredible community once again!

I had a previous encounter with Gladstone Solicitors back in 2018. Fortunately, by requesting a Subject Access Request (SAR), I was able to deter them from sending anymore fraudulent £300 fine letters to my mother.

However, today I checked my credit score and noticed a significant decrease from 999 to below 700. This was due to a £297 County Court Judgment (CCJ) dated 17/04/2023 appearing on my credit report. Unfortunately, I missed the 30-day window to reluctantly pay the judgment to get it removed. 

I contacted the County Court Business Centre, referencing the Case Number, and discovered that the CCJ was related to a fine for parking at Kilve Beach on 31/12/2021. Gladstones was listed as the solicitor for this case. The address associated with the Case Number is an old address, so this is my first notification regarding the matter. I updated my driving licence shortly after moving to a new house on 22/01/2022.

After reading the Newbies Section, it seems advisable to set aside by paying £275 for the N244 form. Should I send a SAR to Premier Parking Ltd to gather information for the Witness Statement (WS)?

I'm not in an ideal situation, especially since I plan on relocating to New Zealand at the end of the year. I hope to resolve this matter before then, but I fear I may be overly optimistic. My primary concern is removing the CCJ from my credit record!

    You obviously neglected to update your V5C, which you can do online.

    You need to notify all parties of your change of address and tell them to erase the old one.

    Yes you need to apply for a Set Aside based on the fact that the claim was incorrectly served. The solicitors failed to do a soft search in order to confirm your current address.

    You need to apply for the set aside in a timely manner so it is important you act promptly. Did you request that the CCBC email you the PoC.

    I'm sure one of the more knowledgeable regulars will be along soon to add more.

    If you are leaving the country soon why is a CCJ a problem?
    Can you not just leave it there and forget about it?

    V5C was updated in February 2022 as I sold the car. I'll apply for the set aside this weekend. I didn't ask CCBC to email Particulars of Claim (I'm that is what you are referring to) as I didn't know I could, but happy to call again if you feel it's important. Thanks!

    Can you not just leave it there and forget about it?
    I may return within 6 years and rather have it dealt with. I'm not sure of the procedure regarding a CCJ and my visa either to be completely honest.

    Knowing the PoC is essential as any defence would be based on it. 

    The address used to correspond with the RK was the address on the V5C on or within a few days of the parking event. If that address is not your current address or the address you were at around a week later, then you will not have received any correspondence.

    KADOE rules apply (look them up). The CCJ was a default one because the solicitors or the PPC didn't bother to do a soft search for your correct address. On that basis, you should apply for a set aside under CPR13.2 and 13.3 and ask for the N244 fee to be paid by the claimant for not doing their job properly because they are just a bunch of bottom-dwelling lazy bar stewards.

    If you are not bothered about having a CCJ on your credit file for 6 years and you have no need to apply for credit in that period ad you are going to be living abroad anyway, just leave it.

    There is no PPC called Premier Parking Ltd but just do a CCJ set aside and ask the Judge to order the £275 to be repaid to you by the PPC.

    When are you leaving the country. Dont assume you can have the hearing done via phone/cvp or on the papers. Depending on the court the judge may insist on a f2f hearing
