- I received a formal letter of claim (not ccc) of £170 from dcbl (11 days after the date stamp
) regarding a cp plus/groupnexus PCN at moto services (ANPR) dated 2019 with 30 days notice to pay/respond.
- The car broke down a few days after that and I left it sitting at a discreet location for a month before scrapping it and I had also moved house.
- Ergo, this is the first time hearing of it so I don't have any evidence/PCN/information about this matter.
- I've requested a SAR
- Next paragraph isn't important if you're short for time, just weird correspondence regarding an email of complaint (following Coupon-mad's Newbies thread) to the manager of moto:
Received a response from the executive manager instead of the manager that they would pass it on to parking queries.
They claimed to be unable to help as "under GDPR, we do not hold any information on the drivers, visits or vehicles that park on any of our services. Therefore we cannot be involved in the appeals process as we do not have the relevant details to be able to do so".
I asked how she knew what date the PCN was given (in her response she stated the date which I did not share) if under the GDPR ... no access to any information. Also that it is my understanding that GroupNexus/CP Plus do not own the land, therefore, the manager may have the authority to have a claim cancelled. Her only response was "we are unable to assist you further without your consent to share your correspondence with the parking company and to be contacted directly by them to discuss the matter".- The stage I kindly ask help with would be to check the email I'm writing to dcbl; I'm not sure if it's appropriate to send separate emails (what order) or an all-in-one email (i.e. 'on hold', request to know legal authority for adding £70 and request for evidence):
Dear Sir or Madam,
Regarding dcbl claim reference: xxxxxxx
I am seeking debt advice but I deny any debt and the case must be put 'on hold' for not less than 30 days under the PAP for debt claims 2017.
I have sent your client a SAR.
Additionally, I request to know what your legal authority is for adding £70 to your claim. I refer to ....[inserting beamerguy's large template]... reply within 7 days from the date of this email with your intentions.
As all previous correspondence from you was sent to the wrong address and as such never received, I request that you send me the PCN and evidence as soon as possible.
Please update my correct address for service as: xxxxxxx
- I understand the next step is to draft a defense although I can't do that without knowing what exactly the PCN is for.

When you receive your Claim Form please tell us the Issue Date on it.2 -

It's fine. Nothing will stop the claim so doesn't matter what you say. Only use the above if you WANT the claim delayed until July.

I would leave out that paragraph starting "Additionally,".
I would also suggest the the address correction be dealt with separately by sending an email direct to Groupnexus's Data Protection Officer.

(c) also confirm your correct 'address for service' if you've moved and the PPC has two addresses.
You are correct, I do not want to wait until July but I did hope to get some information from the SAR in order to prepare a defence.
So I don't have to reply to them at all until I receive a court claim?
I have sent Groupnexas DPO my correct address do I need to send one to dcbl (so I know if they are pressing forward)?
Do I send beamerguy's template (request to know legal authority for adding £70 and request for evidence) before or after a court claim?

You are not clear. You say you have received a "formal" LoC but from DCBL. Is that DCBL or DCB Legal? Two different arms of the same organisation. DCBL cannot send you a "formal" LoC. Only DCB Legal can do that on behalf of their client.

Do reply (it looks better if this reaches a hearing) but don't talk about any of that.If you don't want the claim delayed just respond briefly but robustly setting out the basis of your defence and tell them you are taking advice on MSE forum, and you know they will discontinue this claim once well defended. DCBLegal are just wasting everyone's time with bulk litigation, designed to frighten victims and pick off low hanging fruit. Urge them to save the claim filing fee and drop hands now because you are not one of those victims. If not, bring on the claim and stop faffing around.PRIVATE 'PCN'? Well we don't know; only you do. It's your PCN.
