Empty Box Delivered by Sky Mobile

I ordered an iPhone 13 from Sky Mobile.
A packaged arrived from the courier DPD, the brown cardboard box looked intact complete with security perforated tabs.
Inside was a white Apple box that also looked intact complete with security perforated tabs.
But the white box was empty with no phone inside.
I complained, and Sky conducted an investigation and came back 2 weeks later to say as far as they were concerned the delivery was compliant and that I was liable for the device.
They are planning to keep billing me every month for the payments.
I am livid, I have received and empty box and now being charged £700 for the priviledge.
Surely this can't be down to me to rectify?

If Sky won't budge your recourse is the small claims procedure

If they've conducted their own investigation already, it's down to you to dispute it, yes. They're not going to just give away £700 on your say-so.
Report it to the police, get a crime number and go back to the retailer. That'll show you're serious about pursuing it.

This type of crime seem to be very common. I just ordered an iPad and opted to collect from Apple Store precisely because I was concerned it might be hijacked.0

I don’t see why the FOS would be relevant here though. OP would need to go through the complaints process for the finance provider first before they can refer to FOS. So you’re right, at the moment there’s no grounds for that.eskbanker said:
