PPS ticket disabled bay

I received a Penalty Charge Notice from Premier Parking Solutions today. I'm a blue badge holder and parked in a disabled bay. I've been struggling with sleep and pain recently and forgot to display my blue badge, even though I'm entitled to use the bay
I'm aware that it's not legally enforceable and I'm aware that I am in the wrong for not displaying my badge and I'm very angry at myself over it. I have lodged an appeal and sent a copy of my blue badge but not admitted liability. I have asked for photographic evidence that I haven't displayed my badge.
Has anyone received a PCN for this and had it overturned? I'm unwaged so this is going to hit hard if I lose the appeal and have to pay

But you don't pay when you lose the fake appeal. And you don't have a Penalty Charge.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It is not a penalty.
Please confirm the full name of the PPC as there are at lease two with those initials.
You do not have to pay anything unless a judge says so, even if you lose the appeal.
Plan A is always a complaint to the landowner and your MP, reminding them both about the strict requirements of the Equality Act 2010.
As you say, the BB scheme does not apply on private land, and failing to allow reasonable adjustments for a disable person is indirect discrimination. Pursuing the charge once the "service provider" is aware of a person's disabilities is direct discrimination. Both are criminal offences.
Reasonable adjustments should include anticipating the needs of disabled persons, and certain types of disabilities including those that cause pain can cause forgetfulness.I married my cousin. I had to...I don't have a sister.

You have far more chance of getting this cancelled by appealing to the retailer or landowner. PPCs don’t make any money by accepting appeals.4

Thanks coupon mad. It's a parking charge notice, you're quite right.
At the moment I'm not planning on paying the charge to Premier Parking Solutions Ltd and I'm hoping that a decent human being will see sense and drop it. Unfortunately stress increases my pain so I'm hoping this is resolved soon.0 -
Unregulated private parking companies are not run by decent human beings. They only care about making money and sod everyone else.
Stick with us. We are the good gals and guys.
Do contact the landowner and your MP. You could also contact the Minister of State (Minister for disabled people, Health and Work), the Secretary of State for Health and Social Care, and the head of the Department for Levelling Up, Housing & Communities.
The latter is the government department responsible for introducing the new mandatory parking code of practice. Although not yet active, it proposes that PPC s must cancel PCNs where a disabled motorist fails to display a blue badge, but later provides proof the held one at the material time.
Remind the PPC, the landowner, and your MP that this is the will of parliament.

Thank you all for being so incredibly helpful. I know I should have waited to see if I got a letter before appealing but I was stressed and anxious to make this go away.
I have drafted a response to the company having found the Director name and address and have no intention at this current time of paying until I receive a court summons to do so. I am asking for a genuine pre estimate of loss to the landowner that this charge represents. If my appeal is turned down, I will take this to POPLA and then to court. Genuinely hoping that the appeal will be upheld because I would like to have faith in people!
I'll keep you informed.0 -
Forget pre-estimate of loss. That went out in 2015 with the infamous ParkingEye v Beavis Supreme Court ruling.
PoPLA is not an option either because PPS are IPC members who run a kangaroo court where you stand a less than 5% chance of winning.
Plan A is always the best option. Lay heavy on the breach of Equality Act 2010 and the fact that indirect and direct discrimination are criminal offences.

They will not drop it, they don't care about you, only getting your money.
Have you told them that you are disabled and have a protected characteristic as per the equalities act ( formerly disability discrimination act)
If not do so as soon as possible, it will more than likely not get it cancelled, but it will help further along the line.
Disabled, protected characteristic, equalities act, reasonable adjustment, are all key important terms to use in a complaint to the parking company that will help with a landowner complaint.
Also who's car park is this? From the Plain Language Commission:

As I've already submitted my appeal do I post this further letter now or wait for outcome of appeal?Fruitcake said:Forget pre-estimate of loss. That went out in 2015 with the infamous ParkingEye v Beavis Supreme Court ruling.

I have the directors address so can post it directly there? (interestingly they have multiple defaulted payments to banks and building societies!).0 -

Premier Parking Solutions Ltd Newton Abbot own and regulate the car park. I contacted the store on the retail park and the owners of the retail park stores who confirmed this0
