PPI Plevin Refund - Advice Required

Hello,
I am writing this on behalf of my father and hoping someone can help me. My father made three PPI claims via a claims company a few years ago and managed to get some money back from all three lenders he had borrowed from. One of the lenders that he had a successful Plevin PPI claim from was Lloyds Bank.
Recently a claims company called "Ashley Howard" has been ringing my father saying previously banks were only obliged to refund commission in excess of 50% and not the full amount. The claims company have told my father that he could be owed £3399.25. They have sent my father a Case to Answer damages based agreement to sign and return. The agreement says "No Win, No Fee" and that if my father was to win they would take 35% + VAT as their fee. The agreement also says that this will be a collective claim with other claims and if the case goes to court the claims company will seek to take out event insurance on my fathers behalf so he does not have to pay the fees for the other party if the other party wins but a premium is payable by my father out of the compensation awarded if he wins.
Basically I've told my father to avoid them with a barge pole and not to engage with the claims company. He's got money back previously from PPI via a claims company and that's why he wants to go ahead however I am worried that he may end up out of pocket if he's ordered to pay something in future, even though they say no win no fee.
The two questions I have are:
1. Is there any scenario where my father could be out of pocket if he was to win or lose the case as he wants to go ahead?
2. I thought the date to make a PPI claim had passed so I am not sure why this claims company have contacted my father?

Run away.
They'll ask him to fund the insurance just before he's set to win a load of money.
He'll then sadly fail to get the load of money in an unexpected twist, despite coming so close.
He'll also be signing up to a suckers list, to receive lots of other new and exciting money making schemes in the future.1 -
