mikemhac said:Hi All,
Current update contac ted MP who contacted British Parking Association who said Ocean don enothing wrong and result still stands. Ocean as good will gesture have reduced fee from £160 to £100 for 14 days. I am terminally ill with cancer is it worth making them aware of that or will they just speed things up to make sure they catch me while they can.So sorry to hear that news.
Yes tell them and ask for that they cease and desist with the choices being:
- no debt demands and allow 'breathing space'
or
- full cancellation and an apology to leave you alone due to clear health vulnerability
or
- a court claim now - AS IN THIS AUTUMN - no delay and no threatograms or fake added £70 because that's likely to be banned (again) this month, if MSE forumites' predictions are true.
Tell them to stop prolonging the agony with useless 'offers' because you won't be paying unless a Judge tells you to.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok the debt recovery company is now quoting supreme court ruling www.supremecourt.uk/cases/uksc-2015-0116.html which my understanding after reading all 60 odd pages of the judgement surround whether or not the charge is a penalty or not, Given that I have legitimately bought a ticket and then parked in a disabled bay I don't see how this is affected by this judgement. Furthermore they stated that Blue badge scheme does not apply , therefore am under any obligation to display it on dashboard which I believed I had done till it got knocked off in any event. Under the disability legislation they should be providing places for people with disabilities some of whom s disability doesn't qualify for a blue 0obadge. Do I engage with the debt company and put this argument forward or do I just leave it. Any input appreciated as this is weighing on me and at this rate it may still be ongoing when I "pop my clogs"0

Do not engage in any way with a debt collector. They are powerless to do anything to you, other than send you silly letters. Have you contacted your MP and asked him/her to help you with this, they can often weigh heavily on private parking firms? In all honesty, Ocean are pretty much small fry in the grand scheme of things, we don't see any major interest by them in pursuing court claims, and I can't see them taking that route with you, especially given your circumstances (so sorry to hear about your illness).
Just ignore anything from the debt recovery firm and see what transpires beyond their shenanigans. Come back to us if you receive anything further direct from Ocean, or from solicitors representing them (highly unlikely).Have you written to Ocean to explain your health condition, I think it's important you do that, as recommended by @Coupon-mad, above? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

mikemhac said:Yes I did miss the thread have you got a link to it pleaseNo link was needed because the forum search works fairly well if you'd searched for good keywords. Easy to spot that thread.
And it's constantly on page one every day as people add their photos - please help by adding yours.
Anyway, we sincerely hope that you are au fait with the need to respond to the private parking draft Impact Assessment by mid-September?Or let me do a submission containing YOUR photo evidence please...You want to help us change the law?
To be clear, we are nearly there; it's not a petition or some weak campaign, it's a final push on a law already passed, to cap the £PCN levels and ban the fake DRA fees.
The Government has a Call for Evidence open right now.
We are wanting photos of unmanaged car parks, Hospital car park signs near you that show £50 or £60 as the deterrent, and Aldi, Asda, Tesco or Sainsburys £70 signs please.
Here on page 6 I summarise what pics I need:
https://forums.moneysavingexpert.com/discussion/6463361/dluhc-private-parking-code-government-launches-call-for-evidence-discussion-thread/p6
We need photo evidence of low or no deterrent car parks near you, please!
NOT £100, NOT £90 or £80.
Signs for lower sums, or sites with no PPC.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
